The Committee makes its internal rules for issues related to notices to attend me<strong>et</strong>ings, to the<br />

agenda for me<strong>et</strong>ings, to the organisation of sessions, to <strong>de</strong>bates and to votes.<br />

These internal rules are subject to the approval of the Minister having Transports in his remit.<br />

Article 150:<br />

The Committee can s<strong>et</strong> up the committees of Province, City and District which will ease its<br />

mission.<br />

Part 8. IMPOUNDING<br />

Article 151:<br />

Impounding, which may follow a material immobilisation as provi<strong>de</strong>d for in Article 24 of Law<br />

n° 34/97 of September 1987 relating to Road Traffic Police, is the transfer of a vehicle to a<br />

place <strong>de</strong>signated by the Administrative Authority to hold it there till the lather's <strong>de</strong>cision at the<br />

expenses of the vehicle owner.<br />

Article 152:<br />

The impounding is or<strong>de</strong>red by a Public Prosecution officer who is territorially comp<strong>et</strong>ent, either<br />

following immobilisation of which the offence cessation was not established after forty-eight<br />

hours, or in cases provi<strong>de</strong>d for in Article 36 of Law n° 34/1987 of 17 September 1987 relating<br />

to Road Traffic Police.<br />

An -cases provi<strong>de</strong>d for in this Article, the reporting agent refers to the territorially comp<strong>et</strong>ent<br />

Public Prosecution Officer. He can do it, if need be, after immobilisation in conditions provi<strong>de</strong>d<br />

for in Article 31 of Lawn° 34/1987 of 17 September 1987 relating to Road Traffic Police.<br />

Article 153:<br />

Are used as impounding places all official garages as appointed by the Minister entrusted with<br />

Transports. The Prefect or the Mayor may appoint other public places to be used as impounding<br />

places and ensure their guarding.<br />

Article 154:<br />

An impounding statement will be ma<strong>de</strong> in a report. Every such report must bear the following<br />

mentions:<br />

- The offence which has motivated the impounding;<br />

- The day and hour at which the vehicle was immobilised;<br />

- The vehicle's i<strong>de</strong>ntification (plate, make, engine and chassis number);<br />

- Names of the driver and of the reporter as well as the number of the driving licence;<br />

- The state of the vehicle at time of impounding and its accessories.<br />

The report is established in two copies of which one copy is given to the owner of the vehicle<br />

and the original to the qualified agent. Article 155: The amount of expenses shall be d<strong>et</strong>ermined<br />

by a Decree of the Minister entrusted with justice on recommendation of the Authority entrusted<br />

with road traffic control.
