PRESIDENTIAL DECREE NO 85/01 OF 02/09/2002 REGULATING GENERAL<br />

TRAFFIC POLICE AND ROAD TRAFFIC<br />

Part 1. PRELIMINARY PROVISIONS<br />

Chapter 1. AREA OF APPLICATION<br />

Article 1:<br />

This Decree regulates traffic on the public highway, of pe<strong>de</strong>strians, of vehicles and loa<strong>de</strong>d or<br />

mounted draught animals, and livestock.<br />

Chapter 2. DEFINITIONS<br />

Article 2:<br />

Fur application of provisions of this <strong>de</strong>cree: 1. The term " Public highway" <strong>de</strong>signates all roads,<br />

stre<strong>et</strong>s, public places, parking stations, paths, footpaths, bridges, ferries, as a whole, and<br />

generally speaking, all ways opened to public traffic by land;<br />

2. The term « Roadway » <strong>de</strong>signates part (s) of the public way usually left fur vehicles, while a<br />

public highway. may inclu<strong>de</strong> several road ways separated by a central pavement or different<br />

levels.<br />

3. The term " Way suitable fur motor vehicles" <strong>de</strong>signates the roadway and pavements on the<br />

same level;<br />

4. The term " Traffic lane" <strong>de</strong>signates any one of the longitudinal parts of the roadway<br />

materialised or nut by continuous or discontinuous marks, but having sufficient width to allow<br />

the traffic of one file of vehicles other than cycles, motorcycles or bicycles;<br />

5. The term "Cycle lane" <strong>de</strong>signates the portion of the public highway affected, by special roadsigns,<br />

to the traffic of bicycles and motorcycles;<br />

6. The terms "Cross-roads" and "Intersection" <strong>de</strong>signate any crossing at the same level, junction<br />

or fork of' public highways, including places formed by such crossings, junctions or forks;<br />

7. The term "Footpath" <strong>de</strong>signates a narrow public way accessible only to the traffic of<br />

pe<strong>de</strong>strians or of two wheel vehicles;<br />

8. The term "Path" <strong>de</strong>signates a public way larger than a footpath but which in normal<br />

conditions is not accessible to automobile vehicles traffic. The path keeps its nature when it<br />

presents the aspect of a roadway only at its junction with another public way;<br />

9. The term " Built-up area" <strong>de</strong>signates any space which comprises closely if not continuously<br />

built buildings, bor<strong>de</strong>ring one or the other si<strong>de</strong> of the public way or of which entries and exits<br />

are especially <strong>de</strong>signated by signposts;<br />

10. The term "Driver" <strong>de</strong>signates any person who directs a vehicle or who, on the public way,<br />

gui<strong>de</strong>s loa<strong>de</strong>d or mounted draught animals, or isolated animals or herds;<br />

11. The term "qualified agent" <strong>de</strong>signates one of the agents specified in Article 3 of this Decree,<br />

when visibly wearing the symbols of his functions.<br />

When the user is not in motion, the agent is not obliged to respect that requirement but he then<br />

has to justify his quality.<br />

12. The term "Vehicle" <strong>de</strong>signates any means of transport by land, and any moving, farming ,<br />

industrial or other material;
