Stellungnahmen i zugunsten radikal gewandelter Klimapolitik wird die Ausrufung eines<br />
Notstandes <strong>als</strong> geeignete Vorbedingung der Reformmaßnahmen gefordert. Da die<br />
Auswirkungen des Klimawandels <strong>als</strong> katastrophische Zuspitzung von<br />
Umweltzerstörungen und <strong>als</strong> Bedrohung der Menschheit beschrieben werden, scheint es<br />
nahe zu liegen, von einem Notstand zu sprechen, der außergewöhnliche<br />
Rechtsbefugnisse erforderlich macht.<br />
3.1 Ausprägungen von Notstandsregeln<br />
Notstandsgesetze sind in der Staatenwelt weit verbreitet. 1996 hatten, so zeigen<br />
Auswertungen von juristischen Datenbanken (vgl. Keith 2004; Humphreys 2006), 147<br />
Staaten irgendeine Form von Notstandsgesetz, in 40 Staaten wurden diese auch häufig,<br />
regelmäßig oder konstant genutzt. Keith (2004: 1078ff) hat eine Typologisierung des<br />
Charakters von Notstandsgesetzen vorgenommen, die mit folgenden Unterscheidungen<br />
und Variablen arbeitet:<br />
„1. Legislative Declaration. This variable is coded 2 = responsibility for declaring the<br />
state of emergency is given explicitly to the legislative branch; 1 = states of emergency<br />
(declared by the executive) are explicitly subject to confirmation by the legislature; 0 =<br />
no mention of who has the power to declare such a state; and _1 = the executive branch<br />
is explicitly given the power to declare a state of emergency with no mention of a role<br />
for the legislature or courts.<br />
2. Cannot Dissolve Legislature. This variable is coded 2 = the legislature<br />
may not be dissolved during the emergency or meets “by right”; 1 = vague provision for<br />
legislature meeting but no explicit prevention from dissolving the legislature (i.e., may<br />
