ABSTRACT
In this section, its included the final report related to the research carried out by
the author, with support of the Regional project of support to the education, training
and investigation in human rights in central America through the Institute of
Humans Rights of the University of San Carlos of Guatemala -IDHUSAC- and of
the Institute of Legal Investigations of Legal Investigations of the University Rafael
Landívar -IIJ/URL-.
This investigation reviews the historical evolution of the “principles of equality
and universality of the human rights” arose from the settlement of the Republic at the
end of the last century. Also it presents a philosophical discussion on the conception
of “equality” and the “universality” of the human rights, with clear concepts as:
“homogenize”, “appraisal of the difference”, “cultural relativisms” “discrimination”
and “equity”. For this discussion, the conventions and treaties regarding human
rights and rights for women were taken into account.
Afterwards, it is presented a legislative analysis about the evolution and application
of the “principle of equality of the human rights” for the Guatemalan citizens
in the constitutional texts which have been the ones that the country has counted
on until now. Also, some articles are analyzed, not only about the Penal Code, but
also the Prosecution Penalty which is the mean to flagrantly violate some women’s
rights.
In the report of this investigation it is described, besides, the situation of the
enjoyment of the human rights of Guatemalans, using as variable the following
rights: the political participation, work, education, the property and possession of
the land, reproductive health, access to the justice.
