6 <strong>The</strong> Fleet <strong>Command</strong>er will attempt to resolve the<br />

problem at their level.<br />

b. <strong>Navy</strong> personnel will NOT knowingly make false accusations of<br />

sexual harassment. Persons reporting unfounded incidents will<br />

be punished.<br />

10. Procedures for Resolving Sexual Harassment/Equal Opportunity<br />

Complaints<br />

a. All reported incidents of sexual harassment will be investigated<br />

and resolved at the lowest appropriate level.<br />

b. All incidents, whether formal or informal, will be investigated<br />

within three days of initial notification. Confidentiality will<br />

be maintained to the maximum extent possible.<br />

c. <strong>The</strong> complainant should be notified that the:<br />

(1) Investigation has begun.<br />

(2) Complaint is resolved.<br />

d. Counseling support and social services are made available for the<br />

personnel involved in incidents of sexual harassment.<br />

e. Personnel found guilty of sexual harassment may receive one or<br />

more of the following:<br />

(1) ____________.<br />

(2) Negative entries into evaluations.<br />

(3) Punishment under the UCMJ, Article 92, “Failure to obey<br />

order or regulation.”<br />

For example, as a result of a Captains Mast for using<br />

racially explicit language, an airman recruit:<br />

(a) Was required to forfeit ½ month’s pay ($596.00).<br />

(b) Lost his/her nuclear clearance eligibility and was<br />

reclassified.<br />

(c) Received an entry in his/her service record to<br />

document the misconduct.<br />

(4) Separation from the <strong>Navy</strong>.<br />

f. Military personnel shall be processed for administrative<br />

separation on the first substantiated incident of sexual<br />

harassment involving:<br />

(1) Actions, threats, or attempts to influence another’s career<br />

in exchange for sexual favors.<br />
