language or deportment towards a warrant officer,<br />

noncommissioned officer, or petty officer.<br />

(b) Example<br />

1 In November 2004, a male seaman recruit was found<br />

guilty of using disrespectful language toward a<br />

chief because of saying to her, “Chief, you can<br />

kiss my #$%.”<br />

2 <strong>The</strong> seaman recruit was awarded forfeiture of one<br />

month’s pay ($552.00).<br />

(8) Article 77, Principles<br />

(a) Any person is punishable under the UCMJ who commits an<br />

offense or is involved in its commission.<br />

(b) A person who aids a criminal or is responsible for<br />

someone else committing a crime is also punishable.<br />

(9) Article 78, Accessory after the fact--A person that knows a<br />

crime has been committed can be punished for assisting the<br />

offender avoid capture.<br />

(10) Article 79, Conviction of lesser included offense<br />

(a) An accused may be found guilty of a lesser offense<br />

when guilt for a more serious offense cannot be<br />

proven.<br />

(b) For example, if you are found not guilty for “missing<br />

movement,” (e.g., not aboard when your ship leaves<br />

port) you could be found guilty of unauthorized<br />

absence (UA), a lesser offense.<br />

(11) Article 80, Attempts--Persons who attempt to commit a crime<br />

and fails are punishable under the UCMJ.<br />

(12) Article 81, Conspiracy--Any person who conspires with any<br />

other person to commit a crime is punishable by courtmartial.<br />

(13) Article 82, Solicitation--Any person who solicits or<br />

advises another to commit any of the following, is<br />

punishable under the UCMJ:<br />

(a) Desertion<br />

(b) Mutiny and sedition (hostile action against the U.S.<br />

government)<br />

(c) Misbehavior before the enemy<br />
