(b) While in a position of authority, maltreats fellow<br />

prisoners without justifiable cause.<br />

(34) Article 106, Spies--Any person in time of war who is found<br />

to be a spy will be punished by death; e.g., an enemy spy<br />

looking for vital information at a U.S. Naval Air Station.<br />

(35) Article 106a, Espionage<br />

(a) Any person who, with the intent to cause injury to the<br />

United States or an advantage for a foreign nation,<br />

transmits or attempts to transmit an object relating<br />

to the national defense to a foreign nation is guilty<br />

of espionage; e.g., providing the enemy with<br />

classified military photographs.<br />

(b) Anyone found guilty of espionage will be punished as<br />

directed by a court-martial; espionage can be<br />

punishable by death.<br />

(36) Article 107, False official statements--Any person is<br />

punishable under this article who, with intent to deceive<br />

knowingly:<br />

(a) signs a false official document.<br />

(b) makes a false official statement.<br />

(37) Article 108, Military property of the United States: sale,<br />

loss, damage, destruction, or wrongful disposition—Any<br />

person is punishable under this article who, without proper<br />

authority, does or causes any of the following to U.S.<br />

military property:<br />

(a) Sells/disposes.<br />

(b) Willfully or through neglect, damages, destroys, or<br />

loses.<br />

(38) Article 109, Property other than military property of<br />

United States: Waste, spoilage, or destruction--Any person<br />

who willfully or recklessly wastes, spoils, or wrongfully<br />

destroys or damages any nonmilitary property of the United<br />

States is in violation of this article.<br />

(39) Article 110, Improper hazarding of vessel<br />

(a) Danger--To put in danger of loss or injury.<br />

(b) Any person who willfully, wrongfully, or negligently<br />

hazards or causes hazarding to any vessel of the armed<br />

forces shall suffer death or other punishment as<br />

directed by a court-martial.<br />
