(60) Article 133, Conduct unbecoming an officer and a gentleman-<br />

-Any commissioned officer, cadet, or midshipman (student at<br />

the U.S. Naval Academy) can be convicted of conduct<br />

unbecoming an officer and a gentleman; e.g., making false<br />

official statements, insulting another officer.<br />

(61) Article 134, General article--Any act not covered in other<br />

articles of the UCMJ that violates good military order and<br />

discipline. For example:<br />

(a) Adultery<br />

(b) Fleeing the scene of an accident<br />

(c) Pimping<br />

(d) Prostitution<br />

(e) Fraternization<br />

e. Punitive Articles of the UCMJ review<br />

6. Meanings of Articles 7 Through 14 of the UCMJ<br />

a. Article 7, Apprehension (taking a person into custody)<br />

(1) Persons authorized to apprehend violators of the UCMJ may<br />

do so with reasonable belief that:<br />

(a) An offense has been committed.<br />

(b) <strong>The</strong> person apprehended committed the offense.<br />

(2) Commissioned officers, warrant officers, petty officers,<br />

and noncommissioned officers have authority to quell<br />

quarrels, frays, and disorder among persons subject to the<br />

UCMJ.<br />

b. Article 8, Apprehension of deserters--Civilian law enforcement<br />

officers may apprehend deserters.<br />

c. Article 9, Imposition of restraint--No member can be arrested or<br />

confined without probable cause.<br />

d. Article 10, Restraint of persons charged with offenses—a person<br />

charged with a minor offense shall not ordinarily be confined.<br />

e. Article 11, Reports and receiving of prisoners--No federal<br />

marshal (military chief of police), commander, guard, or master<br />

at arms may refuse to keep any prisoner committed to his/her<br />

charge by a commissioned officer, when the officer furnishes a<br />

signed statement of the offense charged against the prisoner.<br />
