(2) <strong>The</strong> term “uniform” is used because the document applies<br />

equally to the U.S. <strong>Navy</strong>, Marines, Army, Air Force, and<br />

Coast Guard.<br />

(3) Under the UCMJ, the U.S. Armed Forces can bring criminal<br />

charges against personnel who violate military law.<br />

b. Purpose<br />

(1) Promote justice.<br />

(2) Assist in maintaining good order and discipline in the<br />

armed forces.<br />

(3) Promote efficiency and effectiveness in the military.<br />

3. Persons Subject to the Uniform Code of Military Justice (UCMJ)<br />

a. Article 2, Persons subject to this chapter--Persons are subject<br />

to the UCMJ if they:<br />

(1) Are members of the regular armed forces. This includes<br />

recruits.<br />

(2) Are awaiting discharge after an enlistment term has<br />

expired.<br />

(3) Have volunteered (from the time of muster or acceptance<br />

into the armed forces).<br />

(4) Have been inducted formally as a military service member.<br />

(5) Are in the reserves.<br />

(6) Are retired members who are entitled to receive pay.<br />

(7) Are serving a sentence imposed by court-martial.<br />

b. Article 3, Jurisdiction to try certain personnel<br />

(1) All persons subject to Article 2 of the UCMJ can be tried<br />

by the armed forces.<br />

(2) A person may be tried by court-martial, even after leaving<br />

the service, for offenses committed while under the UCMJ.<br />

4. Rights of Service Members According to the Uniform Code of Military<br />

Justice (UCMJ)<br />

a. Article 137, Articles to be explained<br />

(1) Certain UCMJ articles must be explained to each enlisted<br />
