two years (inspection and documentation of defects two
years after completion). In addition, this poses the risk
that the selected contractor may no longer be able to perform
at this point in time.
a. Provision of security
It must therefore be ensured that the client is backed by a
security amounting to the cost of remedial work also in
the fourth year. The interesting point from a legal perspective
is that, in technical terms, there might indeed by circumstances
in favor of postponing the remedy of defects.
On the legal side, this delay must be backed by the provision
of an appropriate security. This can take eff ect only by
way of an agreement, as opposed to a court decision.
b. Price reduction
The fact that no hard aggregate layer exists, which obviously
cannot be retrofi tted in conjunction with the OS 13
coating, gives rise to a price reduction. The overpaid price
must be reimbursed on the basis of the unit price of this
hard aggregate layer. If the absence of this layer results in
technical inferiority of the work completed, the corresponding
reduction in value must also be compensated.
The following parameters can be used for this purpose:
shortened maintenance intervals, shorter service life, other
increased technical risks. The price reduction could
also account for the restriction in use continuing until
such time as the defects are remedied.

a. Gestellung einer Sicherheit
Deshalb muss sicher gestellt werden, dass der Auftraggeber
auch noch im vierten Jahr über eine Sicherheit in
Höhe des Mängelbeseitigungsaufwandes verfügt. Rechtlich
interessant ist also, dass aus technischer Sicht durchaus
Umstände für eine verschobene Mängelbeseitigung
sprechen können. Dem muss rechtlich durch Sicherheitsleistung
entsprochen werden. Das kann nur durch eine
Vereinbarung und nicht durch ein Urteil geschehen.
b. Minderung
Da die Hartstoff schicht nicht vorhanden ist, die off enkundig
nachträglich im Zusammenhang mit der OS 13-Beschichtung
nicht mehr aufgebracht werden kann, ist insoweit
eine Minderung veranlasst. Der zu viel bezahlte Preis
ist in Ausrichtung am Einheitspreis dieser Hartstoff -
schicht zurückzuzahlen. Wenn deren Fehlen einen technischen
Minderwert der ausgeführten Leistung verursacht,
ist zusätzlich dieser Minderwert auszugleichen.
Insoweit können als Parameter dienen: verkürzte Instandhaltungsintervalle,
kürzere Lebensdauer, sonstige
erhöhte technische Risiken. Die Minderung könnte auch
die eingeschränkte Nutzung bis zur Nachbesserung berücksichtigen.
