Fee band<br />
The defi nition of the fee band for the project is governed<br />
by section 5 HOAI (new version) but also by the evaluation<br />
criteria pursuant to section 50 HOAI (new version).<br />
Fee<br />
The fee is determined by the minimum fee if the parties<br />
do not agree on a diff erent rate when awarding the contract<br />
(section 7 para. 6 HOAI).<br />
Chargeable costs<br />
Chargeable costs are determined according to section 48<br />
HOAI (new version); as before, several options are available<br />
to the parties. Section 48 para. 1 HOAI (new version)<br />
provides the basis for all other provisions. Pursuant to this<br />
paragraph, the structural engineer accounts for 55% of<br />
the structural design cost and 10% of the cost of technical<br />
installations (previously 20% according to section 62 para.<br />
4 HOAI, old version). This means that the calculation is<br />
based on cost group 300 according to DIN 276-1: 2008-12<br />
in relation to structural design costs and cost group<br />
400 specifi ed in the same standard in relation to technical<br />
installations.<br />
Pursuant to section 6 para. 1 HOAI (new version),<br />
chargeable costs should be stated in accordance with the<br />
cost calculation (costing model). The structural engineer<br />
is involved in the costing exercise at work stage 3.<br />
It is also possible to link the costing to a building cost<br />
agreement (section 6 para. 2 HOAI, new version, building<br />
cost agreement model). If the architect commissioned<br />
with project planning enters into such a building cost<br />
agreement with the client, this has generally no binding<br />
eff ect on the structural engineer. This may be diff erent,<br />
however, if the structural engineer contributes to the determination<br />
of verifi able building costs.<br />
Special services<br />
Special services (referred to in Schedule 2, Item 2.10) may<br />
be owed under a contract for work because it would not be<br />
possible to achieve the contractually agreed outcome without<br />
them. The structural engineer must ensure that a related<br />
contract is entered into and that a fee is agreed upon<br />
(section 3 para. 3 HOAI, new version).<br />
Other services and changes to chargeable costs<br />
The previously existing link to costing or cost estimate in<br />
accordance with section 62 para. 2 Items 1 and 2 HOAI<br />
(old version) is replaced with the costing and building cost<br />
agreement model. Any changes determined by the client<br />
in the course of the project that have an eff ect on costs, as<br />
well as the repeated rendering of planning or design services<br />
that had previously been provided at the various work<br />
stages, call for an increased attention to detail already<br />
when entering into the contract and in the course of the<br />
project since section 7 para. 5 and section 3 para. 2 sentence<br />
2 HOAI (new version) contain provisions regarding<br />
the security of the fee. For both reasons, i.e. because of the<br />
other services (section 3 para. 2 sentence 2 HOAI, new<br />
version) and their eff ect on chargeable costs, it is absolutely<br />
necessary to enter into agreements.<br />

Honorarsatz<br />
Der Honorarsatz bestimmt sich nach dem Mindestsatz,<br />
wenn die Parteien nicht bei Auftragserteilung einen abweichenden<br />
Satz vereinbaren (§ 7 Abs. 6 HOAI).<br />
Die anrechenbaren Kosten<br />
Die anrechenbaren Kosten bestimmen sich nach § 48<br />
HOAI n.F., wobei die Parteien – wie bisher auch – Wahlmöglichkeiten<br />
haben. Den Ausgangspunkt bildet § 48<br />
Abs. 1 HOAI n.F. Danach setzt der Tragwerksplaner 55 %<br />
der Bauwerk-Baukonstruktionskosten und 10 % der<br />
Kosten der Technischen Anlagen (bisher 20 % nach § 62<br />
Abs. 4 HOAI a.F.) an. Die Ausrichtung erfolgt damit an<br />
der Kostengruppe 300 der DIN 276-1: 2008-12 hinsichtlich<br />
der Kosten der Baukonstruktion und der Kostengruppe<br />
400 derselben DIN bezüglich der technischen Anlagen.<br />
Anzusetzen sind nach § 6 Abs. 1 HOAI n.F. die anrechenbaren<br />
Kosten nach Maßgabe der Kostenberechnung<br />
(Kostenberechnungsmodell). An deren Erstellung wirkt<br />
der Tragwerksplaner in der Lph 3 mit.<br />
Möglich ist auch eine Anbindung an eine Baukostenvereinbarung<br />
(§ 6 Abs. 2 HOAI n.F., Baukostenvereinbarungsmodell).<br />
Schließt der objektplanende Architekt eine<br />
derartige Baukostenvereinbarung mit dem Auftraggeber,<br />
folgt hieraus grundsätzlich keine Bindung des Tragwerksplaners.<br />
Das kann anders dann sein, wenn der Tragwerksplaner<br />
Beiträge hinsichtlich der Ermittlung nachprüfbarer<br />
Baukosten liefert.<br />
Die Besondere Leistung<br />
Besondere Leistungen – Punkt 2.10 der Anlage 2 – können<br />
werkvertraglich geschuldet sein, weil ohne sie der<br />
geschuldete Erfolg nicht erreichbar ist. Der Tragwerksplaner<br />
hat dafür Sorge zu tragen, dass insoweit eine Beauftragung<br />
erfolgt und eine Honorarvereinbarung geschlossen<br />
wird (§ 3 Abs. 3 HOAI n.F.).<br />
Die andere Leistung und Veränderung<br />
hinsichtlich der anrechenbaren Kosten<br />
Die bisher – § 62 Abs. 2 Nr. 1 und Nr. 2 HOAI a.F. – gegebene<br />
Anbindung auch an die Kostenfeststellung bzw. an<br />
den Kostenanschlag wird durch das Kostenberechnungs-<br />
wie auch das Baukostenvereinbarungsmodell beendet.<br />
Im Verlauf der Objektabwicklung seitens des Auftraggebers<br />
angeordnete Änderungen mit Auswirkungen auf die<br />
Kostenentwicklung wie auch die erneute Vornahme von<br />
bereits in den Leistungsphasen erledigten Planungsleistungen<br />
fordern zu massiver Aufmerksamkeit bereits bei<br />
Vertragsschluss und im Verlauf der Projektabwicklung<br />
heraus. Denn es geht nach § 7 Abs. 5 und § 3 Abs. 2 Satz 2<br />
HOAI n.F. um Honorarsicherung. Beides, die andere<br />
Leistung (§ 3 Abs. 2 Satz 2 HOAI n.F.) und die Auswirkungen<br />
auf die anrechenbaren Kosten, machen den Abschluss<br />
von Vereinbarungen unbedingt notwendig.<br />
