Legal provisions on liability for material defects<br />
The liability for material defects is governed by the law<br />
pertaining to contracts for work. Either the BGB or, if<br />
agreed upon, the VOB/B applies. According to the statement<br />
of the case, the legal acceptance procedure was completed,<br />
which is why warranty law in accordance with the<br />
old concept is relevant.<br />
The defect<br />
Since a load-bearing capacity of 15 kN/m 2 was agreed for<br />
the cast-in-situ fl oor, all arguments speak in favor of considering<br />
this an agreed quality or condition pursuant to<br />
section 633 para. 2 sentence 1 BGB or section 13 No. 1<br />
VOB/B. This means that this quality must be achieved at<br />
any rate. If this is not the case, the guaranteed freedom of<br />
material defects is lacking. Another legal option would be<br />
to assume a contractually specifi ed purpose or use. If this<br />
use cannot be ensured, this would result in a material defect<br />
if this situation does in fact compromise the fi tness<br />
for purpose of the work. This argument should be supported<br />
because the load-bearing capacity of the fl oor was<br />
reduced to approx. 78% of the specifi ed value. This has a<br />
signifi cant adverse eff ect on the warehouse and handling<br />
capacity, which is confi rmed by the fact that the client requires<br />
the construction of a new building with a fl oor<br />
space of 900 m 2 .<br />
Attribution of the defect<br />
The defect is to be attributed both to the contractor and the<br />
structural engineer.<br />
a) Responsibility of the contractor<br />
The contractor must assume liability for the defect because<br />
it is due to a fault in the execution of the work. At the<br />
column heads, the reinforcement is located too deeply (at<br />
a level of 50 to 65 mm compared to the specifi ed depth of<br />
30 mm). This causes a reduction in the load-bearing capacity<br />
by one third. Another laying fault is that the main<br />
reinforcement was inserted as the second layer in one of<br />
the concreting sections.<br />
b) Responsibility of the structural engineer<br />
The defect is also attributable to the structural engineer<br />
because the reinforcement plan lacks information on<br />
which support reinforcement layer to insert as the top<br />
layer. For this reason, the plans are factually incomplete. A<br />
separate issue is that the structural engineer had accepted<br />
the reinforcement in all three concreting sections. During<br />
the acceptance procedure, he could and should have recognized<br />
that the position of the reinforcement did not correspond<br />
to the technical specifi cations, i.e. that the reinforcement<br />
was located too deeply. Wherever mesh<br />
Sachmängelhaftungsregeln<br />
Die Sachmängelhaftung bestimmt sich nach Werkvertragsrecht.<br />
Einschlägig ist entweder das BGB oder bei<br />
Vereinbarung die VOB/B. Nach Sachverhalt ist die rechtsgeschäftliche<br />
Abnahme erfolgt, weswegen im Sinne der<br />
alten Begriffl ichkeit das Gewährleistungsrecht einschlägig<br />
ist.<br />
Der Mangel<br />
Da für die Ortbetondecke eine Tragfähigkeit von 15 kN/<br />
m 2 vereinbart worden ist, spricht alles dafür, insoweit eine<br />
vereinbarte Beschaff enheit nach § 633 Abs. 2 Satz 1 BGB<br />
oder § 13 Nr. 1 VOB/B zu bejahen. Das bedeutet, dass diese<br />
Qualität auf jeden Fall vorliegen muss, andernfalls die<br />
versprochene Sachmangelfreiheit fehlt. Als andere rechtliche<br />
Einordnung könnte eine vertraglich vorausgesetzte<br />
Verwendung angenommen werden, deren Fehlen dann<br />
zu einem Sachmangel führt, wenn hierdurch die Verwendungseignung<br />
tatsächlich eingeschränkt ist. Das ist zu<br />
bejahen, denn die Tragfähigkeit der Decke ist auf ca. 78 %<br />
des Soll-Werts reduziert. Das wirkt sich auf die Lager- und<br />
Umschlagskapazität erheblich einschränkend aus, was<br />
aus der Tatsache ersichtlich wird, dass der Auftraggeber<br />
fl ächenmäßig auf die Neuerrichtung einer Halle mit einer<br />
Nutzfl äche von 900 m 2 angewiesen ist.<br />
Zurechnung des Mangels<br />
Der Mangel geht zu Lasten des Unternehmers wie auch<br />
des Tragwerkplaners.<br />
a) Verantwortlichkeit des Unternehmers<br />
Der Unternehmer muss sich den Mangel deshalb zurechnen<br />
lassen, weil er auf einen Ausführungsfehler zurückgeht.<br />
Die Bewehrung liegt an den Stützenköpfen im Vergleich<br />
zur Soll-Lage von 30 mm mit 50 bis 65 mm zu tief.<br />
Die Folge ist, dass sich die Tragfähigkeit um ein Drittel<br />
reduziert. Ein weiterer Verlegefehler besteht darin, dass<br />
die Hauptbewehrung in einem Betonierabschnitt in der<br />
zweiten Lage liegt.<br />
b)Verantwortlichkeit des Tragwerksplaners<br />
Der Mangel geht auch auf den Tragwerksplaner zurück.<br />
Denn im Bewehrungsplan fehlt die Angabe, welche Lage<br />
der Stützbewehrung als obere zu verlegen ist. Die Planung<br />
ist deshalb sachlich unvollständig. Davon zu trennen<br />
ist, dass der Tragwerksplaner bei allen drei Betonierabschnitten<br />
die Bewehrung abgenommen hat. Dabei<br />
hätte er erkennen können und müssen, dass die Lage der<br />
Bewehrung den technischen Erfordernissen nicht entspricht,<br />
die Bewehrung nämlich zu tief liegt. Dort, wo es<br />
im Stützbereich zur Verwendung von Matten kam, war<br />
außerdem wegen Übergreifungsstößen der Einsatz nied-<br />
