Summary Especially having regard to the LPA's aspirations for on-site power generation in Policy NTE/8, there is absolutely no justification for wind turbines outside the<br />

SSA being restricted in the manner which parts '2' and '3' of the Policy advocate.<br />

Indeed, the LPA will be aware that the Council have granted themselves consent for a turbine that conflicts with this proposed guidance and another<br />

'conflicting' proposal has recently been granted on appeal. It is clearly National Policy to encourage wind turbine development, all applications should be<br />

considered on their merits and not constrained by these inappropriate and unnecessary constraints.<br />

Change Sought: Delete the constraints in parts '2' and '3' of the Policy.<br />

Summary There would appear to be a significant inconsistency between the policy requirements for community benefit and the text which indicates that there is no legal<br />

or planning requirement for a devloper to provide community benefits.<br />

Change Sought:<br />

It is our belief that it is legitiamate for the LPA to require or accept developer contributions in respect of "compensation or mitigation" and to take these into<br />

consideration when determining the planning application. However it is considered that benefits which are simply "sharing benefits with the local community"<br />

should not be taken into account in the planning application determination process.<br />

The Policy and text need to be rewritten to make it quite clear what developer contributions can legitimately be taken into account when a planning application<br />

is being determined, and those which should not be. The latter may be regarded as "sweeteners" to enlicit local support for a proposal and should not be seen<br />

to have any influence in the planing process.<br />

Summary The definition of large-scale wind turbine development in Criterion 1 of this policy (5MW) is different to the 25MW definition used in Technical Advice Note 8<br />

(TAN8): Renewable Energy (2005) and Planning Policy Wales (Edition 4, 2011). Unless clear justification is provided as to why the LDP definition of 'large<br />

scale' should be different to that set out in national policy, we recommend that the policy is amended to use definitions consistent to those used in national<br />

planning policy (to meet Test of Soundness C2).<br />

Change Sought: As currently drafted it is not clear how Criterion 1(e) meets the provision set out in paragraph 12.10.5 of Planning Policy Wales. We therefore recommend that<br />

Criterion 1(e) is amended by inserting "Where appropriate" at its start (to meet Test of Soundness C2).<br />
