Clean Water Act—Total Maximum DailyLoad Program (Section 303(d))Section 303(d) of <strong>the</strong> Clean Water Act created <strong>the</strong>Total Maximum Daily Load (TMDL) program toaddress waters in <strong>the</strong> nation that still do not meet <strong>the</strong>Clean Water Act goal of “fishable, swimmable” afterimplementing pollution control technology at pointsources of pollution. Under <strong>the</strong> TMDL program,states must identify and develop TMDLs <strong>for</strong> suchwaters with EPA oversight. A TMDL is <strong>the</strong> maximumamount of a pollutant, from both point and nonpointsources, that can be accommodated while still meetingwater quality standards. States must develop aTMDL <strong>for</strong> each pollutant of concern, and developand implement plans to achieve and maintainTMDLs by allocating reductions among point andnonpoint sources.Web: .See Section 3 (Federal Laws): Clean Water Act.Clean Water Act—Water QualityCertification Program (Section 401)The Clean Water Act Section 401 program, administeredby EPA, requires federal agencies to obtain certification,or to require permit applicants to do so, from<strong>the</strong> state, territory, or Indian tribes be<strong>for</strong>e issuing permitsthat would result in increased pollutant loads towaters and wetlands. The certification is issued onlyif such increased loads would not cause or contributeto violations of water quality standards. The program targets funding to sixteenhigh priority coastal ecosystems.
