v. If any portion of the work is carried out without prior<br />

approval in writing of the Engineer or his representative to<br />

proceed with such work.<br />

vi. If concrete is honeycombed or damaged or in the opinion<br />

of the Engineer <strong>particular</strong>ly weak in important or critical<br />

areas of the structure where weakened concrete will affect<br />

the ability of the structure to carry design loads;<br />

vii. Any other circumstances attributed to alleged negligence<br />

on the part of the contractor which, in the opinion of the<br />

Engineer, results in the <strong>works</strong> or any part thereof being of<br />

less than the expected strength;<br />

viii. Any reason other than the foregoing.<br />

2. If the loading tests be instructed to be made solely or in part for<br />

the reasons 1.8.1(I to VII) the tests shall be made at the<br />

contractors own cost, whether the results of such tests be<br />

satisfactory or otherwise. If the tests are instructed to be made<br />

for the reason 1.8.1(VIII) hereinbefore specified, the contractor<br />

shall make the tests and shall be reimbursed for all costs relating<br />

thereto irrespective of the results of the tests.<br />

3. All the loading tests and other tests will be carried out strictly in<br />

accordance with the instructions of the Engineer. Load testing will<br />

generally follow the procedure set out in Indian Standard Codes<br />

of Practice, but the Engineer is not bound to follow the Indian<br />

Standard Codes of Practice and in his absolute discretion may<br />

issue instructions differing from the procedure set out in the<br />

Indian Standard Codes of Practice.<br />

4. If in the opinion of the Engineer the result of the loading tests is<br />

not satisfactory the Engineer shall instruct that such parts of the<br />

<strong>works</strong> as he specifies shall be taken down or cut out and
