Also, by the process of judicialreview judiciary control of delegated legislation is accomplished as courts havethe ability of declaring a certain decision unlawful.In the same way, the existence of ministerial responsibility and of the “vote ofno confidence” is efficient instruments of limiting power.To conclude, it was shown that despite of the inexistence of a writtenconstitution in the English legal system, judiciary, executive and legislature donot exercise power in an arbitrary way and that explicit and efficient rules doexist and by the means of constitutional conventions, historical customs andjudicial rules, the balance of power is maintained.QUELQUES TRAITS DU SYSTÈME JURIDIQUE BRITANNIQUE(Résumé)L’auteur met en discussion quelques traits spécifiques mais aussi essentiels du systèmejuridique britannique de “Common Law” afin de répondre aux questions importantes qui porte surles limites du pouvoir du juge, les attributions des pouvoirs exécutif et législatif dans le contextedu manque d’une constitution écrite.A notre avis, les pouvoirs juridique, exécutif et législatif offrent la possibilité d’êtremises en pratique plus flexible que dans les systèmes continentaux de droit. Le juge britanniqueaussi dispose des attributions plus larges par comparaison avec ses collègues européens. Il ne fautpas croire dans une grande liberté car des limites telles les conventions constitutionnelles ou lacoutume historique gardent encore leur importance et assurent l’équilibre entre les pouvoirs tout enempêchant aucun exercice abusif.
