Scope of Services Draft<br />

3.7. Program Criteria Document:<br />

3.7.1. City shall provide its objectives, limitations, program requirements, Project<br />

budget requirements (including design-to-budget target), <strong>and</strong> other relevant<br />

information regarding the Project to DB (“Program Criteria Document”).<br />

3.7.2. The Parties acknowledge that City’s Program Criteria Document is not more<br />

than _______ percent (__%) complete <strong>and</strong> that, with City’s assistance, DB<br />

shall develop the Program Criteria Document to completion. In doing so, DB<br />

shall:<br />

3.7.2.1 Consult with City to further define <strong>and</strong> clarify City’s requirements for<br />

the Project, <strong>and</strong> available data<br />

3.7.2.2 Identify, consult with, <strong>and</strong> analyze the requirements of governmental<br />

authorities having jurisdiction to approve parts of the Project; (iii)<br />

inspect existing site conditions<br />

3.7.2.3 Review laws, ordinances <strong>and</strong> regulations that are applicable to the<br />

design <strong>and</strong> construction of the Project, <strong>and</strong> correlate them to the<br />

Project; (v) identify the type <strong>and</strong> duration of manufacturers’ warranties<br />

to be procured as part of the Project<br />

3.7.2.4 Iinclude the design-to-budget target amount as one of the bases for<br />

the Program Criteria Document.<br />

3.7.2.5 Format the Program Criteria Document into a report form which shall,<br />

as appropriate, contain schematic design layout, sketches <strong>and</strong><br />

conceptual design criteria with appropriate exhibits to indicate the<br />

agreed-to requirements <strong>and</strong> considerations revolved<br />

3.7.2.6 Perform any other reasonable task that is necessary to develop the<br />

Program Criteria Document to completion <strong>and</strong> to the reasonable<br />

satisfaction of City.<br />

3.7.3. City’s Review of Program Criteria Document. DB shall furnish a draft of the<br />

Program Criteria Document to City no later than the Scope Confirmation Date<br />

identified in EXHIBIT G, “Key Project Dates.”<br />

3.7.4. Revisions to Program Criteria Document. DB shall revise the Program<br />

Criteria Document in response to City’s written comments, <strong>and</strong> shall furnish a<br />

copy of the revised Program Criteria Document to City within _________ (__)<br />

days of reviewing it with City.<br />

3.7.5. Approval of Program Criteria Document. Once approved in writing by City,<br />

the Program Criteria Document shall become an AGREEMENT DOCUMENT<br />

<strong>and</strong> shall be one of the bases for the <strong>Design</strong> Documents to be prepared by<br />

DB.<br />

3.7.6. Modification to Program Criteria Document. City’s approval of <strong>Design</strong><br />

Documents that contain deviations, properly flagged by DB, from the Program<br />

Criteria Document shall be deemed to be a corresponding modification to the<br />

Program Criteria Document.<br />

3.8. Contract Specifications:<br />

3.8.1. Use Microsoft Word, latest version, unless otherwise agreed. Font shall be<br />

11 point Times New Roman as supplied with the latest Microsoft Windows<br />

Operating System. No special or headline fonts are allowed. Exact page<br />
