unauthorized persons to Airport-restricted areas or inadvertent entry of<br />

dogs or large animals into the AOA.<br />

2) Ten Foot Rule: No Contractor will be permitted to store materials, park<br />

equipment or erect permanent or semi-permanent structures within ten<br />

(10) feet of either side of the AOA perimeter security fence.<br />

Obstructions to Navigation<br />

A. Penetrations of the imaginary surfaces defined in FAR Part 77 shall not be<br />

permitted without advance notification of, <strong>and</strong> approval by, the Engineer. It will<br />

be necessary for the Contractor to file FAA Form 7460-1 with the FAA to obtain<br />

approval prior for operation of equipment 15 feet or more in height, including but<br />

not limited to vehicles, cranes, or other construction equipment, structures,<br />

stockpiled materials, excavated earth, etc. It shall be the Contractor’s sole<br />

responsibility to file this document. Allow at least 45 days for FAA <strong>and</strong> review<br />

<strong>and</strong> approval prior to expected use of such equipment.<br />

B. When penetrations more that 15 feet above ground level (AGL) are unavoidable,<br />

they shall be brought to the attention of the Engineer, as far in advance as<br />

possible to allow NOTAMS to be prepared <strong>and</strong> distributed to appropriate FAA<br />

divisions for publication <strong>and</strong> dissemination. Contractor shall comply with the<br />

provisions of AC 70/7460-1, latest edition, in the marking <strong>and</strong> lighting of<br />

obstacles. The Contractor shall allow at least 45 days for FAA review <strong>and</strong><br />

approval. No delays will be granted the Contractor for his failure to submit the<br />

necessary documents in a timely manner.<br />

B. Depending on the location of the construction site, there may be severe<br />

restrictions on the use of equipment that extends skyward, such as cranes <strong>and</strong><br />

concrete pumping booms. Some of these restrictions include limitations on the<br />

height cranes can be extended during times of reduced visibility, e.g., cranes<br />

may not be raised unless visibility is 3 miles or greater. Contact the Engineer for<br />

further information, prior to submitting a bid, if cranes or other vertically<br />

extendable equipment will be used on the project.<br />

Special Hazardous Substances <strong>and</strong> Processes<br />

A. Special Hazardous Substances <strong>and</strong> Processes. Materials that contain hazardous<br />

substances or mixtures may be required on the Work. A Material Safety Data<br />

Sheet as described in Section 5194 of the California Code of Regulations shall<br />

be requested by the Contractor from the manufacturer of any hazardous products<br />

used.<br />

B. Except as otherwise permitted, the Contractor agrees to accept sole<br />

responsibility for full compliance with any <strong>and</strong> all applicable present <strong>and</strong> future<br />

rules, regulations, restrictions, ordinances, statutes, laws <strong>and</strong>/or other orders of<br />

any governmental entity regarding the use, storage, h<strong>and</strong>ling, distribution,<br />

processing <strong>and</strong>/or disposal of hazardous wastes, extremely hazardous wastes,<br />

hazardous substances, hazardous materials, hazardous chemicals, toxic<br />

chemicals, toxic substances, pollutants, contaminants, or other similarly<br />

regulated substances (hereinafter referred to as "hazardous substances")<br />
