E. All materials, parts, <strong>and</strong> equipment furnished by the Contractor in the Work shall be<br />

new, high grade, <strong>and</strong> free from defects. Used or secondh<strong>and</strong> materials, parts, <strong>and</strong><br />

equipment may be used only if so specified in the contract documents.<br />

F. The quality of materials <strong>and</strong> workmanship shall be subject to approval by the<br />

Inspector. Materials <strong>and</strong> workmanship of quality not conforming to the requirements<br />

of the Specifications shall be considered defective <strong>and</strong> will be subject to rejection.<br />

Defective work or material, whether in place or not, shall be removed immediately<br />

form the Work site by the Contractor, at its expenses, when so directed by the<br />

Inspector.<br />

G. If the Contractor fails to replace any defective or damaged work or material after<br />

reasonable notice, the Engineer may cause such work or materials to be replaced.<br />

The replacement expense will be deducted from the amount to be paid to the<br />

Contractor.<br />

PROTECTION OF WORK AND MATERIALS<br />

A. The Contractor shall provide <strong>and</strong> maintain storage facilities <strong>and</strong> employ such<br />

measures as will preserve the specified quality of materials to be used in the Work.<br />

Stored materials shall be reasonably accessible for inspection. The Contractor shall<br />

also adequately protect new <strong>and</strong> existing work <strong>and</strong> all items of equipment for the<br />

duration of the Contract.<br />

B. The Contractor shall not, without LAWA’s consent, assign, sell, mortgage,<br />

hypothecate, or remove equipment or materials which have been installed or<br />

delivered <strong>and</strong> which may be necessary for the completion of the Work.<br />

C. Access to Work <strong>and</strong> Materials. The Contractor shall provide access at any time to<br />

the Work <strong>and</strong> materials wherever same are stored, being fabricated, erected or<br />

installed, when requested to do so by a representative of the LAWA or other<br />

regulatory subdivisions having jurisdiction.<br />

D. Facilities <strong>and</strong> Labor. The Contractor shall provide sufficient, safe, <strong>and</strong> proper<br />

facilities <strong>and</strong> labor necessary to move, take <strong>and</strong> prepare samples for testing of<br />

materials, <strong>and</strong> shall move same for purposes of additional testing when ordered to<br />

do so by any of the LAWA's representatives.<br />

SHOP INSPECTION REQUIREMENTS<br />

A. When shop inspection is required by the Engineer, a Notification of Fabrication form<br />

shall be submitted by the General Contractor or the Quality Control Manager to the<br />

Materials Control Coordinator.<br />

B. The General Contractor or the Quality Control Manager shall fax the Notification of<br />

Fabrication to the Materials Control Coordinator at 424-646-9327 at least 48 hours in<br />

advance when the fabrication will take place within 50 miles of the project.<br />
