h. After the completion of the Work, the Site shall be cleared of debris<br />

<strong>and</strong> restored to a condition equal to or better than that existing before<br />

construction.<br />

D. The Contractor shall comply with the State Water Resources Control Board<br />

Order No. 2009-0009-DWQ (<strong>Construction</strong> Activities Storm Water General<br />

Permit). Contractor is to determine the Risk Level for the Site in accordance with<br />

State Water Resources Control Board Order No. 2009-0009-DWQ <strong>and</strong> determine<br />

which requirements are applicable.<br />

E. Compliance with State Water Resources Control Board Order No. 2009-0009-<br />

DWQ, may included, but is not limited to the following:<br />

1) Register via the State Water Board’s Storm Water Multi-Application &<br />

Reporting System (SMARTS) system, as coordinated through LAWA.<br />

2) Prepare all Permit Registration Documents.<br />

3) Have a credentialed preparer, as defined in State Water Resources<br />

Control Board Order No. 2009-0009-DWQ, develop a site-specific<br />

Storm Water Pollution Prevention Plan (SWPPP).<br />

4) Submit SWPPP to LAWA Environmental Services Division for review<br />

<strong>and</strong> approval.<br />

5) Implement the SWPPP in accordance with State Water Resources<br />

Control Board Order No. 2009-0009-DWQ requirements, including, but<br />

not limited to necessary <strong>and</strong> appropriate site monitoring, <strong>and</strong> filing of<br />

required reports <strong>and</strong> notifications via SMARTS (in consultation with<br />

LAWA).<br />

6) Prepare a Notice of Termination (NOT) upon completion of said<br />

construction work, fulfill all post-construction requirements under State<br />

Water Resources Control Board Order No. 2009-0009-DWQ, <strong>and</strong><br />

coordinate with LAWA the filing of the NOT via SMARTS.<br />

F. Failure to comply with State Water Resources Control Board Order No. 2009-<br />

0009-DWQ may subject discharges to penalties. Dischargers may become liable<br />

to pay up to $10,000 a day pursuant to California Water Code section 13385, <strong>and</strong><br />

another penalty of a minimum of $1,000 pursuant to sections 13399.25-3399.43.<br />

G. Should the Contractor violate any of the provisions of this Subsection, or if<br />

pollution occurs in the work area for any reason, the Contractor shall immediately<br />

notify LAWA. In addition the Contractor shall, within 10 Days, submit written<br />

confirmation to LAWA describing the incident <strong>and</strong> corrective actions taken.<br />

Contractor is to comply with all discharge reporting requirements of Water<br />

Resources Control Board Order No. 2009-0009-DWQ. If pollution, for whatever<br />

reason, is detected by the Inspector/Engineer before notification by the<br />

Contractor, the required written confirmation shall also include any explanation of<br />

why the Contractor had not notified the Inspector.<br />

Drainage Control<br />

The Contractor shall ensure that storm <strong>and</strong> drainage water does not pond due to the<br />

temporary blockage of exiting drainage facilities. To this end, the Contractor shall<br />

provide temporary methods that allow for the passage of storm <strong>and</strong> drainage water in<br />

a manner equivalent to the existing drainage system.<br />
