1) Manufacturer's name <strong>and</strong> br<strong>and</strong>.<br />

2) Place of sampling.<br />

3) Sufficient information to identify the lot, group, bin, or silo from which the samples<br />

were taken.<br />

4) Amount of material in the lot sampled.<br />

5) Statement that the material has passed the requirements.<br />

6) Signature <strong>and</strong> title of the person creating the affidavit <strong>and</strong> the date of execution<br />

of the affidavit.<br />

CERTIFICATION<br />

A. The Engineer may waive the materials testing requirements <strong>and</strong> accept the<br />

manufacturer’s written certificate of compliance that the materials to be supplied<br />

meet those requirements. Materials test data may be required by the Engineer to be<br />

included with the submittal.<br />

B. A Certificate of Compliance in triplicate shall be furnished prior to the use of<br />

materials for which the Contract Documents require that such a certificate be<br />

furnished. The Engineer may permit the use of certain materials or assemblies prior<br />

to the sampling <strong>and</strong> testing if accompanied by a Certificate of Compliance. The<br />

certificate shall be signed by the manufacturer of the material or the manufacturer of<br />

assembled materials <strong>and</strong> the Contractor, <strong>and</strong> shall state that the materials involved<br />

comply in all respects with the requirements of the specifications. A Certificate of<br />

Compliance shall be furnished with each lot of materials delivered to the work, <strong>and</strong><br />

the lot so certified shall be clearly identified on the certificate. The form of the<br />

Certificate of Compliance <strong>and</strong> its disposition shall be as directed by the Engineer.<br />

C. Materials used on the basis of a Certificate of Compliance may be sampled <strong>and</strong><br />

tested at any time. The fact that material is used on the basis of a Certificate of<br />

Compliance shall not relieve the Contractor of responsibility for incorporating material<br />

in the Work which conforms to the requirements of the Contract Documents <strong>and</strong><br />

such material not conforming to such requirements will be subject to rejection<br />

whether in place or not.<br />

D. The Engineer reserves the right to refuse to permit the use of material<br />

notwithst<strong>and</strong>ing the submittal of a Certificate of Compliance.<br />

TRADE NAMES OR EQUALS<br />

A. The Contractor may supply any of the materials specified or offer an equivalent. The<br />

Engineer will determine whether the material offered is equivalent to that specified.<br />

Adequate time shall be allowed for the Engineer to make this determination.<br />

B. A listing of materials is not intended to be comprehensive, or in order of preference.<br />

The Contractor may offer any material, process, or equipment considered to be<br />

equivalent to that indicated. The substantiation of offers shall be submitted as<br />

provided in the Contract Documents.<br />

C. The Contractor shall, at its expense, furnish data concerning items offered by it as<br />

equivalent to those specified. The Contractor shall have the material tested as<br />

required by the Engineer to determine that the quality, strength, physical, chemical,<br />

<strong>Design</strong> <strong>and</strong> <strong>Construction</strong> H<strong>and</strong>book<br />
