C. The Contractor shall notify the Inspector before noon of the working day before<br />

inspection is required. Work shall be done only in the presence of the Inspector,<br />

unless otherwise authorized. Any work done without proper inspection will be subject<br />

to rejection. The Inspector <strong>and</strong> any authorized representatives shall at all times have<br />

access to the Work during its construction at shops <strong>and</strong> yards <strong>and</strong> while in storage,<br />

as well as to the Work site. The Contractor shall provide every reasonable facility for<br />

ascertaining that the materials <strong>and</strong> workmanship are in accordance with these<br />

Specifications. Inspection of the Work shall not relieve the Contractor of the<br />

obligation to fulfill all requirements of the Contract.<br />

D. The Inspector is authorized to determine the acceptability of materials <strong>and</strong> the<br />

quality of Work. The Inspector is authorized to sample <strong>and</strong> test all materials to be<br />

incorporated into the Work. The Inspector may delegate this authority to sample<br />

materials for construction to an approved public or private testing laboratory to<br />

perform any necessary tests.<br />

E. No Work shall be backfilled, buried, cast in concrete, hidden or otherwise<br />

covered until it has been inspected by the Inspector <strong>and</strong> other Agencies for which a<br />

permit is required. Should the Contractor attempt to cover or conceal any item of<br />

Work prior to its approval <strong>and</strong> acceptance, the Inspector may cause the activity to be<br />

stopped <strong>and</strong> require said Work to be exposed, if determined necessary by the<br />

Inspector, so that proper inspection may take place. All costs for exposing such<br />

Work, including premium costs resulting from alternate means of inspection, time<br />

delays, <strong>and</strong> impacts resulting on other portions of the Work, shall be borne by the<br />

Contractor. All costs of such delays, including its effect upon other portions of the<br />

Work, shall be borne by the Contractor. Where Work that was done without<br />

inspection cannot be uncovered, such as in concrete cast over reinforcing steel, all<br />

such Work shall be subject to demolition, removal, <strong>and</strong> reconstruction under proper<br />

inspection at the expense of the Contractor.<br />

FAULTY AND UNAUTHORIZED WORK<br />

A. Unauthorized work shall be remedied or removed <strong>and</strong> replaced by the Contractor in<br />

an acceptable manner, <strong>and</strong> no added compensation will be allowed for such<br />

removal, replacement, or remedial work. If the contractor chooses to propose repair<br />

of non-conforming work, a repair procedure is required for non-conforming work <strong>and</strong><br />

shall be submitted to the Engineer for review <strong>and</strong> approval prior to any corrective<br />

action taking place. Work done beyond the areas indicated or established by the<br />

Engineer, or any “extra work” done without written authority from the Engineer will be<br />

considered as unauthorized work. Work shall be remedied, removed or replaced at<br />

the Contractor's expense. If the Contractor fails to replace any defective or damaged<br />

Work or material after reasonable notice, the Engineer may cause such Work or<br />

materials to be remedied, removed, or replaced, <strong>and</strong> the cost thereof to be deducted<br />

from any moneys due or which may become due to the Contractor.<br />

B. Except as set forth in this Subsection or elsewhere in Project Specifications, all nonconforming<br />

Work <strong>and</strong> materials, in place or not, shall be removed immediately from<br />

the Site or corrected to conform to all requirements of the Contract Documents, by<br />

the Contractor, at the sole expense of the Contractor. If the contractor chooses to<br />

propose repair of non-conforming work, a repair procedure is required for non-<br />

<strong>Design</strong> <strong>and</strong> <strong>Construction</strong> H<strong>and</strong>book<br />
