Construction Restrictions for the Protection <strong>of</strong> the Nominated Object and<br />

Their Effects<br />

Law on the Protection <strong>of</strong> Cultural Monuments<br />

<strong>of</strong> Baden-Württemberg <strong>of</strong> Jan. 25 th 1971,<br />

revised version <strong>of</strong> Dec. 6 th 1983<br />

§ 8<br />

The Protection <strong>of</strong> Cultural Monuments<br />

in General<br />

(1) Without approval by the authority in<br />

charge <strong>of</strong> the protection <strong>of</strong> cultural<br />

monuments a registered cultural<br />

monument must not<br />

1. be destroyed or eliminated<br />

2. be diminished in its appearance<br />

These construction restrictions apply to<br />

all cultural monuments marked as § 2 in<br />

Enclosure A 5 (constructional<br />

monuments) and to the cultural<br />

monuments included in Enclosure A 8.<br />

These are marked purple on maps 3 &<br />

11 <strong>of</strong> Enclosure A 12.<br />

§ 15<br />

Effects <strong>of</strong> Registration<br />

(in the Book <strong>of</strong> Monuments)<br />

(1) Without approval by the authority in<br />

charge <strong>of</strong> the protection <strong>of</strong> cultural<br />

monuments a registered cultural<br />

monument must not<br />

1. be re-erected or restored<br />

2. be altered in its appearance or<br />

substance<br />

3. be completed with extensions or<br />

superstructures or inscriptions <strong>of</strong> a<br />

general or commercial nature<br />

(3) Also approval has to be sought for the<br />

erection, alteration or elimination <strong>of</strong><br />

objects in the environs <strong>of</strong> a registered<br />

cultural monument if and as far as these<br />

environs are considered <strong>of</strong> substantial<br />

value to the monument. Approval for<br />

other projects has to be sought if these<br />

projects include a change <strong>of</strong> the former<br />

land-use. Approval has to be granted if<br />

the project will diminish the appearance<br />

<strong>of</strong> the monument temporarily or in minor<br />

ways only or if public interest inevitably<br />

calls for the approval.<br />

These additional (extended)<br />

construction restrictions apply to all the<br />

cultural monuments marked as § 12 in<br />

Enclosure A 5.<br />

Prescription on the Protection<br />

<strong>of</strong> Parts <strong>of</strong> the Landscape on the<br />

<strong>Island</strong> <strong>of</strong> Reichenau<br />

dated March 3 rd 1954<br />

§2<br />

(1) Within the boundaries <strong>of</strong> the parts <strong>of</strong> the<br />

landscape defined in §1 any alterations<br />

are prohibited that could cause damage to<br />

nature, diminish its beauty or disfigure<br />

the overall impression <strong>of</strong> the landscape.<br />

(2) To avoid the damaging effects<br />

enumerated in paragraph 1 it is<br />

expressively prohibited to:<br />

a) erect buildings <strong>of</strong> any kind, even<br />

those that under other circumstances<br />

would not afford approval by the<br />
