10.4.3 The Chief Examiner will assess<br />

whether or not there is prima facie<br />

evidence to suggest there has been an<br />

irregularity. If it is the belief of the<br />

Chief Examiner that there may have<br />

been an irregularity, a meeting of<br />

the Examinations Conduct<br />

Committee will be convened to<br />

investigate the matter.<br />

10.5 Notice of meeting<br />

10.5.1 The student(s) concerned must,<br />

within five working days of the<br />

Chief Examiner's decision to<br />

convene a meeting of the<br />

Examinations Conduct Committee,<br />

be sent written notice of the meeting<br />

by the Examinations Officer.<br />

10.5.2 This notification will be in the form<br />

of a prepared statement into which<br />

the Examinations Officer inserts the<br />

relevant details for each student.<br />

The notice must contain the<br />

following:<br />

the date, time and venue of the<br />

examination at which the alleged<br />

breach occurred;<br />

the subject code and name of the<br />

examination;<br />

the student's name and ID<br />

number;<br />

the nature of the alleged breach;<br />

the date and time of the<br />

Examinations Conduct<br />

Committee meeting;<br />

a description of where the<br />

student may get assistance in<br />

terms of preparing his/her case,<br />

including the name and<br />

telephone number of the<br />

Student Union Advocate;<br />

advice that the student may<br />

present any evidence or call such<br />

others relevant to the case which<br />

s/he may present to the<br />

committee.<br />

10.5.3 The meeting will be held as<br />

expeditiously as possible but not<br />

later than five working days from<br />

the date of the notice.<br />

10.6 Examinations Conduct Committee<br />

10.6.1 For the purposes of investigating<br />

alleged irregularities of conduct in<br />

examinations subject to the control<br />

of the Academic Registrar, the<br />

Examinations Conduct Committee<br />

shall consist of:<br />

a) the Chief Examiner (Head of<br />

Teaching School) as Chair;<br />

b) the Subject Convener, or<br />

nominee;<br />

c) the President of the Student<br />

Union, or nominee.<br />

The Examinations Officer (or other<br />

nominee of the Academic Registrar)<br />

will be present at the meeting to act<br />

as Secretary and record the<br />

decisions.<br />

The student concerned may be<br />

represented by an advocate, both of<br />

whom may address the Committee<br />

and provide such information or call<br />

such others as the Committee may<br />

agree. The advocate may not be a<br />

member of the Committee.<br />

10.6.2 Powers of the Examinations<br />

Conduct Committee<br />

If the Committee as convened<br />

according to sections 10.6 and 10.6.1<br />

is of the view by a majority vote<br />

that an irregularity has occurred, the<br />

Committee may, taking into account<br />

the seriousness of the occurrence<br />

and circumstances, decide:<br />

a) to take no action;<br />

b) to reprimand the student;<br />

c) that particular questions in the<br />

examination paper be not<br />

marked;<br />

d) that the examination paper be<br />

cancelled;<br />

e) that the paper for the<br />

examination in question be not<br />

marked and a fail result be<br />

recorded;<br />

f) that the student be required to<br />

undertake further assessment;<br />

g) to suspend the student from the<br />

University for a period up to a<br />

maximum of two semesters;<br />

h) that the student be excluded<br />

from further study in the course.<br />

Such students wishing to reenter,<br />

may apply for readmission<br />

to the course after a<br />

minimum of two years.<br />

10.6.3 Action<br />

a) The student shall be informed in<br />

writing of the decision and<br />

reasons for the decision of the<br />

Examinations Conduct<br />

Committee. Such written advice<br />

shall be mailed to the student's<br />

semester address shown in the<br />

University's records, within five<br />

working days of the<br />

Committee's decision being<br />

made.
