Representation<br />

5.1 A student whom it has alleged has breached<br />

'The Code of Practice' shall have the right,<br />

at any point during the operation of the<br />

Disciplinary Code, to seek the advice and/or<br />

representation from the Student Union or<br />

other advocate of their choosing.<br />

Confidentiality<br />

6.1 Confidentiality will be observed at all times<br />

throughout the exercise of this Student<br />

Disciplinary Code.<br />

Code of Conduct for<br />

Research (Approved by Academic<br />

Board, 1992)<br />

Principles<br />

1.1 Statement of Guiding Principles<br />

This Code of Conduct prescribes standards<br />

of work performance and ethical conduct<br />

expected of all persons engaged in research<br />

in <strong>Swinburne</strong> University of Technology<br />

based upon the following guiding<br />

principles:-<br />

Research is the pursuit of truth.<br />

Research workers should, in all aspects of<br />

their research:<br />

demonstrate integrity and<br />

professionalism,<br />

observe fairness and equity,<br />

avoid conflicts of interest,<br />

ensure the safety of those associated<br />

with the research.<br />

Research methods and results should be<br />

open to scrutiny and debate.<br />

1.2 Observance of the Code<br />

Research workers must familiarise<br />

themselves with the code and ensure that its<br />

provisions are observed.<br />

1.3 Breach of the Code<br />

Failure to comply with the provisions of the<br />

Code may be grounds for<br />

disciplinary action.<br />

1.4 Advice<br />

Where a research worker is in doubt about<br />

the applicability of provision of the Code or<br />

about the appropriate course of action to be<br />

adopted in relation to it, advice should be<br />

sought from a member of the Research<br />

Ethics Sub-Committee of the Research<br />

Advisory Committee. A member of the<br />

Research Ethics Sub-Committee should<br />

provide this advice upon a confidential basis.<br />

Specific Requirements<br />

2.1 Data<br />

2.1.1 Data must be recorded in a durable<br />

form with appropriate references.<br />

2.1.2 Data must be retained intact for a<br />

period of at least five years from the<br />

date of any publication which is<br />

based upon it. Where possible<br />

original data should be retained in<br />

the School or the research unit or, if<br />

located elsewhere, the location<br />

recorded. (Note that it is "data" on<br />

which publications are or will be<br />

based that are to be retained, not<br />

materials).<br />

2.1.3 A School or research unit must<br />

establish procedures for retention of<br />

data.<br />

2.1.4 Research workers must comply with<br />

these retention procedures.<br />

2.1.5 Data related to publications is to be made<br />

available for discussion with other<br />

research workers, except where<br />

confidentiaLty provisions prevad.<br />

2.1.6 Confidentiality provisions relating<br />

to publications may apply in<br />

circumstances where the University<br />

or the research worker has made or<br />

given confidentiality undertakings to<br />

third parties or confidentiality is<br />

required to protect intellectual<br />

property rights. It is the obligation<br />

of the research worker to enquire as<br />

to whether or not confidentiality<br />

provisions apply, and of the head of<br />

the School or research unit to<br />

inform research workers of their<br />

obligations with respect to these<br />

provisions.<br />

2.2 Publications<br />

2.2.1 A publication must contain<br />

appropriate reference to the<br />

contributions made by all<br />

participants in the relkvant research.<br />

2.2.2 "Authorship" is defined as<br />

participation in conceiving and/or<br />

executing and/or interpreting at<br />

least that part of a publication in a<br />

ceauthor's field of expertise,<br />

sufficient for him/her to take public<br />

responsibility for it.<br />

In these terms, any person who has<br />

participated in a substantial way in<br />

conceiving, executing or interpreting<br />

at least the relevant part of the<br />

research should be given the<br />

opportunity to be included as an
