Each examiner should indicate whether the<br />

report is to be made available to the candidate in<br />

whole or in part.<br />

l. Patents and registered designs<br />

The patent rights or right to register a design for any<br />

device, process, chemical or the like which has been<br />

invented or developed by a candidate for the degree of<br />

Master by research in the course of the program being<br />

undertaken for the degree shall, unless otherwise<br />

determined by Council on the advice of the<br />

Divisional Board, be the property of <strong>Swinburne</strong><br />

University of Technology.<br />

12. Confidentiality<br />

It is the Divisional Board's view that in general the public<br />

should have access to the material contained in a Masters<br />

thesis once the degree has been awarded. However, the<br />

Divisional Board recognises that where a program of<br />

research is carried out in or in conjunction with the type<br />

of organisation referred to in 5.2 above, the candidate, in<br />

order to pursue such a program, may be given access by<br />

that organisation to restricted information which the<br />

candidate or the organisation does not wish to disclose<br />

freely. In such cases the Divisional Board must receive, in<br />

writing, from the organisation, notice of such materials<br />

and the reason why, in its opinion, disclosure would be<br />

undesirable.<br />

Where such material is involved the Divisional<br />

Board's prior approval is obtained, the candidate may<br />

submit a thesis in two volumes, one containing the<br />

general thesis, the second containing only the<br />

restricted data or information.<br />

The Divisional Board may restrict access to the<br />

second volume for a specified period.<br />

Where the thesis has only one volume, the Divisional<br />

Board, on receipt of a request in writing from the<br />

candidate and supported by a statement in writing<br />

from the Head of School, may order that, for a period<br />

of up to three years from the date of that order, the<br />

copies of the thesis forwarded to the <strong>Swinburne</strong><br />

Librarv and the school shall be made available onlv --, to<br />

researchers or readers specifically authorised in<br />

writing by the Divisional Board.<br />

13. Copyright<br />

Copyright in the thesis is the property of <strong>Swinburne</strong><br />

University of Technology. Those rights, or any part<br />

of them, may be assigned by Council, on the advice of<br />

the Divisional Board, to the candidate.<br />

14. Change in Policy<br />

The Divisional Board may recommend to the<br />

Academic Board that policies be made under this<br />

statute regarding the admission to candidature, reports<br />

on candidates during the period of candidature, the<br />

examination of candidates and related matters.<br />

15. Change in statute<br />

This statute may be amended from time to time by<br />

Council on the advice of the Academic Board acting<br />

on the recommendation of the Divisional Board. In<br />

the event of an amendment being made subsequent to<br />

the beginning of a student's candidature, that<br />

candidate may elect to continue under the statute<br />

which was in effect at the time candidature began.<br />

Statute for the degree of<br />

Master (by publication)<br />

1. Definitions<br />

1.1 General<br />

Committee means the <strong>Higher</strong> Degrees<br />

Committee of the Academic Board;<br />

Council means the Council of <strong>Swinburne</strong><br />

University of Technology;<br />

University means <strong>Swinburne</strong> University of<br />

Technology;<br />

Divisional Board means the sub-committee<br />

of the University's Academic Board called<br />

the 'Divisional Board' (or any authorised<br />

sub-committee thereof) which is responsible<br />

for studies being undertaken in the area;<br />

Head of School means the person appointed<br />

Head of School in a <strong>Higher</strong> <strong>Education</strong><br />

Division and responsible for studies in the<br />

particular discipline.<br />

1.2 Publication<br />

Publication is a major published paper, a<br />

collection of papers or a monograph. A<br />

publication must be based on original<br />

research, investigation or developmental<br />

work carried out by the candidate in an<br />

industrial, commercial, governmental,<br />

educational or research organisation, or<br />

carried out as a member of the staff of a<br />

college of advanced education provided that<br />

the subject and nature of the research work<br />

are accepted by the University as<br />

appropriate for examination of the award of<br />

the degree of Master.<br />

Title of degree<br />

The degree of Master may be awarded in a field of<br />

study of any faculty of the University. Degrees shall<br />

be designated as follows:<br />

Master of Applied Science MAppSc<br />

Master of Arts<br />

MA<br />

Master of Business<br />

MBus<br />

Master of Engineering MEng<br />

3. Grading of degree<br />

The degree of Master shall be awarded in one grade<br />

only.
