18.4 The Head of School (or Pro Vice-<br />

Chancellor) will meet, within ten working<br />

days, with the student (or representatives of<br />

the group of students) in an attempt to<br />

clarify and resolve the issue.<br />

18.5 With the agreement of the student, the Head<br />

of School (or Pro Vice-Chancellor) will meet<br />

informally with the appropriate member(s)<br />

of staff concerned with the issue and submit<br />

in writing to the staff member(s) concerned<br />

and the Pro Vice-Chancellor of the Division,<br />

details of the meeting and the outcome. A<br />

letter of advice shall also be sent to the<br />

student.<br />

18.6 If the student is not satisfied with the<br />

resolution ~roposed under section 18.5, the<br />

student may appeal to the Academic Registrar<br />

within ten working days of the date of the<br />

advice received under section 18.5.<br />

Such appeals must be lodged in writing with<br />

the Academic Registrar within ten working<br />

days of the date of receipt of the letter of<br />

advice. The letter of appeal shall follow the<br />

format described below:<br />

18.7 Where the Academic Registrar or nominee is<br />

not satisfied that the basis for appeal has<br />

been clearly stated, he/she shall seek further<br />

clarification in writing from the appellant.<br />

The appeal may not be rejected at this point<br />

but must proceed ultimately to the Appeals<br />

Committee.<br />

18.8 The Academic Registrar will refer the matter<br />

to an Appeals Committee comprising<br />

a) the Vice-Chancellor's nominee who<br />

will act as Chair;<br />

b) President of the Student Union or<br />

nominee; and<br />

c) a member of the academic staff of<br />

the <strong>Higher</strong> <strong>Education</strong> Division of<br />

the University chosen by the Chair<br />

of Academic Board. The person so<br />

chosen shall be from a School other<br />

than that in which the student has<br />

been taught.<br />

Representation of both genders<br />

should be attempted wherever<br />

practicable and achievable.<br />

The Academic Registrar (or<br />

nominee) will attend and act as<br />

Secretary<br />

18.9 The written report compiled by the Head of<br />

School under section 18.5 will be forwarded<br />

by the Head of School to the Chair of the<br />

Committee.<br />

18.10 The student or a representative of the<br />

Division may submit any other written<br />

material to the Committee in support of<br />

their case. Any additional evidence so<br />

provided shall be copied to the other party<br />

or parties in the appeal.<br />

18.11 The student must be given at least five<br />

working days' notice in advance of the date,<br />

time and venue of the appeal hearing.<br />

18.12 Students invited to attend a meeting of the<br />

Committee, may be represented by an<br />

advocate who may not be a member of the<br />

Appeals Committee.<br />

18.13 The Appeals Committee shall investigate the<br />

matter in the following manner.<br />

18.13.1 The Committee will meet within<br />

fifteen working days of the date the<br />

formal appeal is made to the<br />

Academic Registrar.<br />

18.13.2 It will consider all written<br />

documentation including the written<br />

statements of the student and staff<br />

member and the written statement<br />

of any witnesses.<br />

18.13.3 The student and a representative of<br />

the Division separately must be<br />

given the opportunity to appear<br />

during the course of the hearing.<br />

18.13.4 The Committee may call before it<br />

the student and other parties<br />

considered appropriate by the<br />

committee.<br />

18.13.5 Committee decisions should be<br />

reached through a majority vote.<br />

18.14 The actions available to the Appeals<br />

Committee shall include:<br />

a) dismissing the case;<br />

b) upholding the case, and finding that<br />

the student has been placed at a<br />

disadvantage and instructing the
