In September 2009, a company submitted an envir<strong>on</strong>mental approval applicati<strong>on</strong> to MNR<br />

to c<strong>on</strong>struct a mining camp and an airstrip to service <strong>the</strong> Ring <strong>of</strong> Fire area.<br />

The project involved 81 hectares <strong>of</strong> Crown land, <strong>the</strong> airstrip, helicopter pads, a fuelling<br />

area, storage facilities and staff accommodati<strong>on</strong>s. Several days into <strong>the</strong> approvals process,<br />

MNR staff flew over <strong>the</strong> site for an inspecti<strong>on</strong> and were surprised to discover that <strong>the</strong><br />

prop<strong>on</strong>ent had already cleared <strong>the</strong> forest, and built <strong>the</strong> mining work camp and <strong>the</strong> airstrip,<br />

both <strong>of</strong> which appeared to be in active use. As a resp<strong>on</strong>se, <strong>the</strong> prop<strong>on</strong>ent said it had<br />

decided to begin c<strong>on</strong>structi<strong>on</strong> because <strong>of</strong> delays in initiating <strong>the</strong> approval<br />

applicati<strong>on</strong> process.<br />

To help prevent future transgressi<strong>on</strong>s, provincial and federal ministries c<strong>on</strong>ducted<br />

informati<strong>on</strong> and training sessi<strong>on</strong>s for companies working in nor<strong>the</strong>rn Ontario in 2010.<br />

These sessi<strong>on</strong>s set out <strong>the</strong> governments’ regulatory envir<strong>on</strong>ment, and <strong>the</strong> requirements for<br />

authorizing mineral explorati<strong>on</strong> activities — not a simple subject, given <strong>the</strong> existence <strong>of</strong><br />

multiple overlapping pieces <strong>of</strong> legislati<strong>on</strong>.<br />

Recommendati<strong>on</strong> 13-3: Employ a risk-based approach for envir<strong>on</strong>mental approvals that<br />

focuses <strong>on</strong> improving outcomes and preventi<strong>on</strong>.<br />

Streamline <strong>the</strong> Envir<strong>on</strong>mental Assessment (EA) process<br />

Many projects trigger both provincial and federal EA requirements as a result <strong>of</strong> differing<br />

legal frameworks.<br />

The Canadian Envir<strong>on</strong>mental Assessment Act (CEAA) covers <strong>the</strong> c<strong>on</strong>duct <strong>of</strong> federal EAs.<br />

The federal EA process applies to projects that are planned by a federal authority; <strong>on</strong> federal<br />

Crown land; those funded by <strong>the</strong> federal government; or those requiring federal licences<br />

or permits.<br />

In an effort to reduce potential duplicati<strong>on</strong>, <strong>the</strong> Canada–Ontario Agreement <strong>on</strong> Envir<strong>on</strong>mental<br />

Assessment Cooperati<strong>on</strong> was struck in 2004. This agreement commits both governments to<br />

c<strong>on</strong>ducting a co-operative EA while retaining <strong>the</strong>ir respective decisi<strong>on</strong>-making powers. 9 In a<br />

recent decisi<strong>on</strong> by <strong>the</strong> Supreme Court <strong>of</strong> Canada, it was noted that resp<strong>on</strong>sible authorities<br />

“can, and should, minimize duplicati<strong>on</strong> by using <strong>the</strong> coordinati<strong>on</strong> mechanisms provided for in<br />

<strong>the</strong> [CEAA]. In particular, federal and provincial governments can adopt mutually agreeable<br />

terms for coordinating envir<strong>on</strong>mental assessments…. Full use <strong>of</strong> this authority would serve to<br />

reduce unnecessary, costly and inefficient duplicati<strong>on</strong>.” 10<br />
