Recommendati<strong>on</strong> 15-1: Establish an independent working group to c<strong>on</strong>sider and determine<br />

which broader public-sector occupati<strong>on</strong>s and industries should be deemed as providing<br />

essential services, <strong>the</strong> appropriate essential-worker designati<strong>on</strong> process, and <strong>the</strong> appropriate<br />

form <strong>of</strong> dispute resoluti<strong>on</strong> mechanism for broader public-sector industries and occupati<strong>on</strong>s.<br />

Recommendati<strong>on</strong> 15-2: Establish <strong>the</strong> overall principles/outcomes necessary for reform to <strong>the</strong><br />

interest arbitrati<strong>on</strong> process going forward.<br />

Recommendati<strong>on</strong> 15-3: The normal course <strong>of</strong> an arbitrati<strong>on</strong> process should begin with<br />

mediati<strong>on</strong>, prior to arbitrati<strong>on</strong>, to attempt to arrive at a negotiated settlement between<br />

<strong>the</strong> parties.<br />

Recommendati<strong>on</strong> 15-4: The arbitrati<strong>on</strong> system needs to be shifted in favour <strong>of</strong> more<br />

objective analysis, based <strong>on</strong> objective criteria, and supported by systematic data<br />

and research.<br />

Recommendati<strong>on</strong> 15-5: Provide zero budget increase for wage costs in <strong>the</strong> Ontario<br />

government so any increases must be accounted for within <strong>the</strong> respective growth rates<br />

recommended in this report.<br />

Recommendati<strong>on</strong> 15-6: Bumping provisi<strong>on</strong>s (i.e., seniority) in collective agreements are<br />

unduly impeding <strong>the</strong> move towards a progressive and efficient public service. The government<br />

needs to work with bargaining agents and employers to explore opti<strong>on</strong>s for modifying <strong>the</strong>se<br />

provisi<strong>on</strong>s and m<strong>on</strong>itor progress towards fixing this problem.<br />

Recommendati<strong>on</strong> 15-7: Do not let c<strong>on</strong>cerns about successor rights in <strong>the</strong> broader public<br />

sector stop privatizati<strong>on</strong>s or amalgamati<strong>on</strong>s that make sense and are critical to successful<br />

reform. Inherited agreements do not live forever; provisi<strong>on</strong>s can be accepted initially and<br />

bargained differently when <strong>the</strong>y come up for renewal.<br />

Recommendati<strong>on</strong> 15-8: C<strong>on</strong>sider expanding <strong>the</strong> authority <strong>of</strong> <strong>the</strong> Ontario Labour Relati<strong>on</strong>s<br />

Board to facilitate <strong>the</strong> establishment <strong>of</strong> effective and rati<strong>on</strong>alized bargaining structures that<br />

support <strong>the</strong> delivery <strong>of</strong> quality and effective public services.<br />

Recommendati<strong>on</strong> 15-9: Fur<strong>the</strong>r rati<strong>on</strong>alize bargaining, while recognizing that multiple models<br />

<strong>of</strong> rati<strong>on</strong>alized bargaining exist (e.g., centralized, co-ordinated, legislated, voluntary). Work<br />

collaboratively with broader public-sector employers and bargaining agents to determine <strong>the</strong><br />

most appropriate model <strong>on</strong> a sector-by-sector basis.<br />
