Envir<strong>on</strong>ment and Natural Resources<br />

Resp<strong>on</strong>sibility for protecting <strong>the</strong> province’s envir<strong>on</strong>mental and natural heritage falls to <strong>the</strong><br />

Ministries <strong>of</strong> <strong>the</strong> Envir<strong>on</strong>ment (MOE) and <strong>of</strong> Natural Resources (MNR). At a time when fiscal<br />

restraint will fur<strong>the</strong>r restrict <strong>the</strong>ir supply <strong>of</strong> funds, it seems certain that demand for oversight<br />

<strong>of</strong> envir<strong>on</strong>mental approvals, compliance and natural resource stewardship will rise.<br />

Our recommendati<strong>on</strong>s are aimed at more effective and efficient operati<strong>on</strong>s.<br />

Full Cost Recovery and User Pay: Full cost recovery is not in effect for all <strong>of</strong> <strong>the</strong><br />

government’s envir<strong>on</strong>mental programs, and existing fees do not keep pace with <strong>the</strong> rising<br />

costs <strong>of</strong> program delivery; where possible, <strong>the</strong> costs <strong>of</strong> those services should be shifted<br />

to <strong>the</strong> beneficiary. The Water Charges initiative should be expanded bey<strong>on</strong>d high users to<br />

medium- and low-c<strong>on</strong>sumpti<strong>on</strong> industries and put <strong>on</strong> a full user-pay basis. The Renewable<br />

Energy Approval, which c<strong>on</strong>solidates <strong>the</strong> range <strong>of</strong> approvals needed for renewable energy<br />

projects while recovering about 90 per cent <strong>of</strong> its direct operating costs, is a good example<br />

<strong>of</strong> a modern approval. The Drive Clean program fully recovers its costs.<br />

Jurisdicti<strong>on</strong>al Crowding: Federal, provincial and municipal governments all set<br />

envir<strong>on</strong>mental rules, with some overlap. Even within <strong>the</strong> Ontario government, regulati<strong>on</strong>s are<br />

set by several ministries. This results in inefficient use <strong>of</strong> government resources and creates<br />

uncertainty and c<strong>on</strong>fusi<strong>on</strong> for industry, developers and citizens. The government should work<br />

to rati<strong>on</strong>alize roles and resp<strong>on</strong>sibilities that are shared by different governments.<br />

The Approvals Process: Growth in natural resource extracti<strong>on</strong> and energy will put pressure<br />

<strong>on</strong> provincial envir<strong>on</strong>mental approvals and compliance systems. The MOE recently launched a<br />

significant transformati<strong>on</strong> <strong>of</strong> <strong>the</strong> envir<strong>on</strong>mental approvals process; it enhances envir<strong>on</strong>mental<br />

protecti<strong>on</strong> with a greater focus <strong>on</strong> risk, resp<strong>on</strong>ds to <strong>the</strong> needs <strong>of</strong> business, takes advantage<br />

<strong>of</strong> current technology and addresses <strong>the</strong> increasing complexity <strong>of</strong> current approvals. Fur<strong>the</strong>r<br />

work should be d<strong>on</strong>e, especially in natural resource extracti<strong>on</strong>.<br />

The Envir<strong>on</strong>mental Assessment (EA) Process: Many projects require both provincial<br />

and federal EA requirements. The 2004 Canada–Ontario Agreement <strong>on</strong> Envir<strong>on</strong>mental<br />

Assessment Co-operati<strong>on</strong> is under review, but removing duplicati<strong>on</strong> may require new<br />

legislati<strong>on</strong> and both governments are reluctant to give up decisi<strong>on</strong>-making authority.<br />

Some projects need envir<strong>on</strong>mental and land use approvals in additi<strong>on</strong> to an EA, though<br />

prop<strong>on</strong>ents are <strong>of</strong>ten unaware <strong>of</strong> this when an EA process begins. The government<br />

should fur<strong>the</strong>r streamline <strong>the</strong> process.<br />
