Chapter 15: Labour Relati<strong>on</strong>s and Compensati<strong>on</strong><br />

The interest arbitrati<strong>on</strong> process in Ontario is a major determinant <strong>of</strong> wage (compensati<strong>on</strong>)<br />

settlements in <strong>the</strong> Ontario BPS for uni<strong>on</strong>ized employees; all hospital employees, l<strong>on</strong>g-term<br />

care workers, police <strong>of</strong>ficers, pr<strong>of</strong>essi<strong>on</strong>al firefighters and Tor<strong>on</strong>to Transit <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g><br />

employees have no right to strike and thus have unresolved bargaining issues decided<br />

through interest arbitrati<strong>on</strong>. Interest arbitrati<strong>on</strong> is also used periodically in o<strong>the</strong>r industries,<br />

such as ambulance services and energy, and is used as a dispute mechanism <strong>of</strong> last resort to<br />

settle disputes after striking employees are ordered back to work.<br />

The system <strong>of</strong> interest arbitrati<strong>on</strong> is very important. Unfortunately, <strong>the</strong> system has recently<br />

come under increasing scrutiny and attack. The arbitrati<strong>on</strong> system thus must not <strong>on</strong>ly work,<br />

but it must be seen to work.<br />

The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> heard many submissi<strong>on</strong>s from employers in <strong>the</strong> BPS claiming that arbitrati<strong>on</strong><br />

is seriously flawed, even broken. Specific charges included <strong>the</strong> granting <strong>of</strong> high compensati<strong>on</strong><br />

awards, ignoring “ability to pay” arguments and l<strong>on</strong>g delays that are sometimes followed by<br />

high retroactive awards that had not been budgeted for.<br />

Our research leads us to make recommendati<strong>on</strong>s to improve <strong>the</strong> arbitrati<strong>on</strong> process. But we<br />

hasten to add that we do not find <strong>the</strong> system to be broken. In general, arbitrati<strong>on</strong> awards have<br />

followed freely negotiated settlements. The noti<strong>on</strong> <strong>of</strong> “ability to pay” is understandably difficult<br />

to apply in <strong>the</strong> public sector where most <strong>of</strong> <strong>the</strong> employer entities could raise taxes if pressed.<br />

Fur<strong>the</strong>r, we found that <strong>the</strong> employer <strong>of</strong>ten did not present evidence <strong>of</strong> this argument to <strong>the</strong><br />

arbitrators.<br />

We believe <strong>the</strong> recommendati<strong>on</strong>s set out below will improve <strong>the</strong> system. However, by<br />

<strong>the</strong>mselves, <strong>the</strong> changes will not materially change <strong>the</strong> sorts <strong>of</strong> compensati<strong>on</strong> increases<br />

awarded through arbitrati<strong>on</strong>. The fiscal situati<strong>on</strong> dictates that those compensati<strong>on</strong><br />

increases must be highly c<strong>on</strong>strained over <strong>the</strong> next several years. That will <strong>on</strong>ly happen if <strong>the</strong><br />

public-sector employers adopt tough, but fair, stances in negotiati<strong>on</strong>s. The pattern will <strong>the</strong>n<br />

likely be reflected in arbitrati<strong>on</strong>.<br />

Wherever government, BPS employers and bargaining agents have established a pattern <strong>of</strong><br />

negotiating moderated wage increases, <strong>the</strong>n interest arbitrators should follow that lead.<br />

Bringing <strong>the</strong> Interest Arbitrati<strong>on</strong> Process under One Ro<strong>of</strong><br />

The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> recognized <strong>the</strong> need to establish principles/outcomes that would assist its<br />

recommendati<strong>on</strong>s for interest arbitrati<strong>on</strong> process reform.<br />

Recommendati<strong>on</strong> 15-2: Establish <strong>the</strong> overall principles/outcomes necessary for reform to <strong>the</strong><br />

interest arbitrati<strong>on</strong> process going forward.<br />
