MARCOR OSH PROGRAM MANUAL 10041004. APPLICABILITY1. This Manual applies to all worldwide afloat <strong>and</strong> ashoreMarine Corps work centers, facilities, equipment, <strong>and</strong> materialexcept in those areas where the Chief of Naval Operations (CNO)has program responsibilities. Exceptions or specificlimitations are made, as required, for conditions governed byother statutory authorities or international agreementsoverseas.2. Provisions of this Manual apply to the prevention of ground,<strong>occupational</strong>, <strong>and</strong> training mishaps. Provisions further includeprevention of all other mishaps caused by equipment or personnelfailures resulting in any of the following:a. Injury or <strong>occupational</strong> illness to military personnel,while on or off duty, including Reserves on active duty, exceptwhen in actual contact with an enemy or as a result of <strong>dir</strong>ectenemy fire.b. Injury or <strong>occupational</strong> illness to civilian personnelemployed by the Marine Corps (including civilians paid fromappropriated <strong>and</strong> non-appropriated funds) when arising out of orin the course of employment. Application of this Manual shallbe consistent with the provisions of Public Law 95-454, CivilService Reform Act of 1978, other provisions of law providingfor collective bargaining agreements <strong>and</strong> procedures, <strong>and</strong> anyagreements entered into pursuant to such provisions. Matters ofofficial leave for employee representatives involved inactivities under this Manual shall be determined per Public Law95-454, or applicable collective bargaining agreements.c. Damage to Marine Corps property or equipment <strong>and</strong> non-Marine Corps property as a result of Marine Corps operations.d. As guidance to prevent injuries to patrons of MarineCorps owned or supervised recreational <strong>and</strong> entertainmentfacilities per MCO 5100.30A (e.g., hobby shops, marinas, bowlingcenters, firing ranges).1-7
