9003 MARCOR OSH PROGRAM MANUALThe appeals process is normally coincident with the originator'schain of comm<strong>and</strong>. At each level of the appeal process,originator shall provide complete documentation, including acopy of the initial report, information on actions taken byreview authority, <strong>and</strong> reasons why dissatisfied with actiontaken.3. The final appeal authority within the Marine Corps is CMC(SD). If the CMC (SD) response does not satisfy originator, thenext level of appeal shall be the Assistant Secretary of the<strong>Navy</strong> (Installations <strong>and</strong> Environment) (ASN (I&E)). The finallevel for appeals within DoD is to Deputy Undersecretary ofDefense (Installations <strong>and</strong> Environment) (D<strong>US</strong>D (I&E)). Theoriginator shall provide copies of all appeals to CMC (SD) <strong>and</strong>the originator's comm<strong>and</strong>er. The appeal shall describe, indetail, the Marine Corps disposition of the report (i.e.,results of the previous level appeal) <strong>and</strong> originator'sobjections to the disposition.4. If not satisfied with final DoD disposition <strong>and</strong> as a lastresort, the originator may contact, in writing, the Office ofFederal Agency Safety Programs, Department of Labor (OSHA),Washington, DC 20210. The appeal must describe in detail theentire processing of the report, furnish copies of all previouslevel appeals, <strong>and</strong> describe originator's objections to the finaldisposition of the unsafe or unhealthful work condition.5. Sequence of appeals for military personnel is via the chainof comm<strong>and</strong> concluding at the Office of the Secretary of Defense.6. The appeal originator should receive a response within 20working days. If at any time during the appeal process, theoriginator does not receive a response within 20 working days,the appeal may be submitted to the next higher reviewingauthority without waiting for a reply. An interim reply shallbe made to the originator of the report when the 20 working dayssuspense cannot be met. An interim reply may meet the responsetime criteria; however, an interim reply shall not take theplace of a final reply.7. Any appeal that bypasses these established procedures willbe returned to the originator.9-6
