OSHA INSPECTIONS. This chapter establishes guidance forinstallation comm<strong>and</strong>ers to use for Federal <strong>and</strong> state OSHinspections <strong>and</strong> investigations at Federal <strong>and</strong> contractorworkplaces on Marine Corps installations.8001. OSH ACT. Public Law 91-596, Occupational Safety <strong>and</strong>Health Act of 1970, provides for the development, promulgation,<strong>and</strong> enforcement of OSHA st<strong>and</strong>ards. The law applies toemployment within the U.S., its territorial waters, territories,or possessions.1. In accordance with E.O. 12196, Occupational Safety <strong>and</strong>Health Programs for Federal Employees, Occupational Safety <strong>and</strong>Health Administration (OSHA) <strong>and</strong> National Institute forOccupational Safety <strong>and</strong> Health (NIOSH) officials, acting asrepresentatives of the Secretary of Labor, are authorized toconduct announced or unannounced inspections of all DoDworkplaces -- except military-unique workplaces <strong>and</strong> nonmilitaryuniqueworkplaces that are staffed exclusively with militarypersonnel.2. DoD contractors operating from DoD or privately ownedfacilities, located on or off <strong>US</strong>MC installations, are"employers" as defined in OSH Act <strong>and</strong> are subject to enforcementauthority by Federal <strong>and</strong> state <strong>safety</strong> <strong>and</strong> health officials.a. Federal <strong>and</strong> state OSHA officials must be granted accessto <strong>US</strong>MC <strong>and</strong> DoD contractor workplaces on DoD installationswithout delay <strong>and</strong> at reasonable times, in accordance withSection 8(a) of Public Law 91-596, except as provided in thisManual.b. Subject to terms of any variance, tolerance, orexemption granted by the Secretary of Labor pursuant to Public8-3
