This chapter establishes guidance forinstallation commanders to use for Federal and state OSHinspections and investigations at Federal and contractorworkplaces on Marine Corps installations.8001. OSH ACT. Public Law 91-596, Occupational Safety andHealth Act of 1970, provides for the development, promulgation,and enforcement of OSHA standards. The law applies toemployment within the U.S., its territorial waters, territories,or possessions.1. In accordance with E.O. 12196, Occupational Safety andHealth Programs for Federal Employees, Occupational Safety andHealth Administration (OSHA) and National Institute forOccupational Safety and Health (NIOSH) officials, acting asrepresentatives of the Secretary of Labor, are authorized toconduct announced or unannounced inspections of all DoDworkplaces -- except military-unique workplaces and nonmilitaryuniqueworkplaces that are staffed exclusively with militarypersonnel.2. DoD contractors operating from DoD or privately ownedfacilities, located on or off USMC installations, are"employers" as defined in OSH Act and are subject to enforcementauthority by Federal and state safety and health officials.a. Federal and state OSHA officials must be granted accessto USMC and DoD contractor workplaces on DoD installationswithout delay and at reasonable times, in accordance withSection 8(a) of Public Law 91-596, except as provided in thisManual.b.
