MARCOR OSH PROGRAM MANUAL 80038003. <strong>US</strong>MC AND DoD CONTRACTOR RESPONSIBILITIES1. <strong>US</strong>MC <strong>and</strong> DoD contractors have the responsibility ofresponding to any citations issued by Federal or state OSHofficials for violations of applicable Federal or state OSHAst<strong>and</strong>ards.2. Full information regarding citations <strong>and</strong> notices issued to<strong>US</strong>MC <strong>and</strong> to DoD contractors for violations of Federal or stateOSHA st<strong>and</strong>ards involving <strong>US</strong>MC furnished equipment, facilities,or other property, shall be referred to the responsibleAdministrative Contracting Office (ACO) for appropriate action<strong>and</strong> provided to CMC (SD).3. <strong>US</strong>MC <strong>and</strong> DoD contractor workplaces may be inspected foraccidents or complaints by Federal or state OSHA officialssubject to the exceptions noted in paragraph 8002.4. <strong>US</strong>MC <strong>and</strong> DoD contractors shall not be provided advancenotice of OSH inspections by Federal or state OSHA officialsexcept:a. In cases of apparent imminent danger to any <strong>US</strong>MC orcontractor employees.b. When requested by Federal or state OSHA officials.NOTE: Any person who violates the foregoing may be subject to afine of not more than $1,000 or imprisonment for not more than 6months, or both.5. Before conducting an inspection of a <strong>US</strong>MC or DoD contractorworkplace situated on a Marine Corps installation, Federal <strong>and</strong>state OSHA officials shall present appropriate identifyingcredentials <strong>and</strong> state the purpose of the visit to theinstallation comm<strong>and</strong>er <strong>and</strong> ACO, as appropriate.6. When Federal or state OSHA officials require entry to asecured area, <strong>and</strong> they cannot effectively be prevented fromaccess to classified material by such means as covering thematerial, the following procedures shall apply:8-5
