8001 MARCOR OSH PROGRAM MANUALLaw 91-596, a state may exercise jurisdiction over OSH mattersinvolving a <strong>US</strong>MC <strong>and</strong> DoD contractor workplace, provided thestate OSH plan has been approved by the Secretary of Labor.<strong>US</strong>MC <strong>and</strong> DoD contractors will be responsible for determining thestatus of applicable state OSH plans.3. Authorized OSH officials from states without OSHA approvedplans may, subject to the exceptions provided elsewhere in thischapter, exercise jurisdiction over OSH matters involving a <strong>US</strong>MC<strong>and</strong> DoD contractor workplace only when there are no relevantOSHA st<strong>and</strong>ards applicable to the work in progress.4. Federal OSH officials may perform OSH inspections in <strong>US</strong>MC<strong>and</strong> DoD contractor workplaces situated in areas where the U.S.holds exclusive Federal jurisdiction.5. Regardless of whether or not a state has a Secretary ofLabor approved plan, state OSH officials have no authority in<strong>US</strong>MC <strong>and</strong> DoD contractor workplaces situated in areas where theUnited States holds exclusive Federal jurisdiction.6. Section 4(b)(l) of Public Law 91-596 does not authorize theSecretary of Labor to assert authority over working conditionsfor which another Federal agency exercises statutory authority.The Secretary of Labor's authority does not extend to workingconditions specifically covered by:a. Any state nuclear <strong>safety</strong> or health st<strong>and</strong>ard orregulation.b. Any explosives <strong>safety</strong> or health st<strong>and</strong>ard or regulation.8002. STANDARDS. OSH st<strong>and</strong>ards, promulgated under provisionsof Public Law 91-596, are enforceable by Federal or state OSHAofficials as follows:1. Federal OSHA officials will enforce only Federal st<strong>and</strong>ardsin <strong>US</strong>MC <strong>and</strong> DoD contractor workplaces.2. State OSH officials operating under a federally-approvedplan may enforce state st<strong>and</strong>ards.8-4
