The contractor shall provide a competent person as requiredin 29 CFR 1910, General Industry; 29 CFR 1915, ShipyardEmployment; or 29 CFR 1926, Construction, <strong>and</strong> as recommended byNIOSH Criteria Document for Confined Spaces; U.S. Army Corps ofEngineers Safety <strong>and</strong> Health Requirements Manual EM 385-1-1; orstate OSH requirements, as applicable. Contractors shallfurnish their own test <strong>and</strong> monitoring equipment, includingpersonal protective equipment.3. Laws <strong>and</strong> regulations make no provision for Marine Corpspersonnel to issue permits for contractor operations.Performance of such functions may involve assumption ofliability by the Marine Corps in event of a mishap. MarineCorps personnel shall not certify spaces or issue confined spaceentry permits for contractor operations or personnel.4. Where Marine Corps <strong>and</strong> contractor personnel are to occupythe same space at the same time, installation or unit CSPM <strong>and</strong>the appropriate contractor representative shall issue separatepermits <strong>and</strong> the contractor shall be informed of Marine Corpsfindings. However, the contracting officer shall inform thecontractor or ROICC that contractor retains legal obligation for<strong>safety</strong> of contractor personnel.4. Marine Corps personnel cannot make an entry or perform hotwork based upon a National Fire Protection Association(NFPA), Certified Marine Chemist, or Competent PersonCertification written for contractor operations.14008. CONFINED SPACE ENTRY PERMIT1. A special permit is required for entry into permit-requiredconfined spaces. Use NAVMC 11405, figure 14-1 for all confinedspace entry permits. This form is available through MarineCorps Electronic Forms System (MCEFS) <strong>and</strong> is also available inthe <strong>Navy</strong> Supply System. A locally produced permit may be usedif all elements of figure 14-1 are included.14-15
