ABSTRACTThis paper intends to investigate the means of participation of indigenous peoplein the political field concerning the regulation by law of traditional knowledge related tobiodiversity. The regulation of access and use of genetic resources and traditionalknowledge concerns to a field of disputes characterized by a multiplicity of institutionsand social agents. Government entities, NGOs, social movements, companies anduniversities take part in the polemic themes that remark this mentioned process ofregulation by law. This paper focus on the indigenous participation in this process andthe effects of their performance with the State and the appropriate law instruments (likelaws, decrees and resolutions) and intends to demonstrate the limits of the right ofparticipation recognized by the Democratic State of Law.Key-words: Traditional knowledge.
