Policy Act (NEPA). 40 CFR 1502.20 notes that agencies are encouraged to tier impact state-<br />

ments to eliminate repetitive material and focus on those issues that are pertinent at the<br />

given level <strong>of</strong> environmental review.<br />

Issue<br />

One commenter suggested that the Statement should note that radioactive waste disposal<br />

<strong>of</strong> any kind is prohibited or severly restricted in several states. (218-DOI)<br />

Response<br />

Since governmental jurisdiction <strong>of</strong> radioactive waste disposal is currently a matter <strong>of</strong><br />

litigation DOE does not consider it appropriate to include in this Statement. The President<br />

in his February 12 statement on radioactive waste management stated "my administration is<br />

committed to providing an effective role for state and local governments in the development<br />

and implementation <strong>of</strong> our nuclear waste management program." By executive order, he subse-<br />

quently established a state planning council to strengthen inter-governmental relationships<br />

to help fulfill joint responsibility to protect public health and safety in radioactive<br />

waste matters.
