SITING ISSUES<br />

Several commenters suggested the Statement note that during repository siting, an eval-<br />

uation should be made <strong>of</strong> the effects on the states' historic, architectural, archeological,<br />

and cultural resources; on other potential energy sources (i.e., hydroelectric power); and<br />

on state and Federal laws. (4-FERC, 31, 39, 70, 184, 218-D01)<br />

Response<br />

The NEPA process does provide the mechanism for ensuring that such concerns are read-<br />

dressed. Examination <strong>of</strong> potential sites will include a detailed examination <strong>of</strong> all the<br />

environmental impacts <strong>of</strong> the repository. This will include examination <strong>of</strong> the effects <strong>of</strong><br />

the repository on historic, cultural, and natural resources and aesthetic values.andqon<br />

enforcement <strong>of</strong> applicable state and Federal laws. Section 2.3 also points out that such<br />

concerns will be addressed in detail as part <strong>of</strong> the site selection process.<br />

Issues<br />

Several commenters stated that if a repository is sited in a particular state, the<br />

Federal government should:<br />

* Give states or communities impact funds. (28, 139)<br />

* Consider mitigating the effects <strong>of</strong> increased monitoring, escorting, and<br />

emergency planning responsibilities <strong>of</strong> the states. (39, 184)<br />

As part <strong>of</strong> the process for siting a waste repository in a state, consideration will be<br />

given to the social and economic effects <strong>of</strong> that siting, including measures for mitigating<br />

undesirable direct and indirect effects. This consideration would be detailed in environ-<br />

mental analyses prepared for a specific site and is beyond the scope <strong>of</strong> a non-site-specific<br />

generic statement such as this. If specific funding to mitigate impacts in states or com-<br />

munities appears appropriate, DOE will need to request authority from the U.S. Congress to<br />

provide such aid. The President has directed the Secretary <strong>of</strong> Energy to provide financial<br />

and technical assistance to facilitate full participation <strong>of</strong> the state and local governments<br />

in review and licensing proceedings.<br />

Issue<br />

One commenter stated that sites selected for waste disposal must satisfy all the<br />

critical technological constraints, even if sites are located on Federally owned property.<br />

(43) Another commenter noted that it is unreasonable to limit site selection to those<br />

sites for which government has "an inferred availability <strong>of</strong> title." Eminent domain would<br />

seem appropriate. (113-EPA)
