Issue<br />

The section entitled Human Institutions calls attention to the merit <strong>of</strong> setting up such<br />

institutions in the long-term control <strong>of</strong> nuclear wastes. It would be helpful to address<br />

whose responsibility it would be to establish and maintain such institutions. (208-NRC)<br />

Response<br />

Institutional arrangement for regulation and control <strong>of</strong> the nuclear waste are the<br />

responsibility <strong>of</strong> the Federal legislature. At present the EPA and NRC have standards set-<br />

ting and regulating jurisdiction while the DOE has ownership control.<br />

One commenter felt that the discussion <strong>of</strong> land use and transportation considerations<br />

does not adequately assess transportation demands. (43)<br />

Response<br />

The discussion on p. 3.1.25 <strong>of</strong> the draft Statement was intended to be only a general<br />

discussion <strong>of</strong> site selection criteria for a geologic repository. For a more complete discussion<br />

<strong>of</strong> transportation demands, see Section 4.5 <strong>of</strong> this final Statement.<br />

Land use and transportation considerations are <strong>of</strong> concern only in the short term.<br />

Compared to the lifetime <strong>of</strong> the repository, this material does apply to the near-term<br />

time period. However, these factors (land use and transportation) do need to be considered<br />

in the site selection process. They would enter into the acceptance or rejection <strong>of</strong> a site<br />

and are included for this reason.
