The volume of 225 pages is a miscellany put together later on, containing almost entirely rough copies, minutes for briefs of Pius V. in the hand of Ant. Florebellus Lavellinus, from March, 1566, to September, 1568 ; only from p. 24-36b, 85-94, and here and there haphazard, are the sheets registers of briefs ; at the end (p. 248 seqq.) there are various matters of another kind. The Landau codex contains no brief which is to be found in the series of the true and proper archives of briefs, and that because it, as well as that in the British Museum, formed part of the aforesaid archives. A careful examination made by Prof. Pogatscher, to whom I here take the opportunity of expressing my gratitude for the help he has given me, showed that only a part of the minutes contained in this volume found their way into the registers of briefs in the Papal Secret Archives. It was upon these latter registers of briefs that the secretary of the Spanish Embassy, Fr. Goubau, drew up his well known collection of the Epistolae Pii V. in 1640. As is the case with the other volumes of minutes, so a comparison of the passages printed in Goubau with the minutes in the Landau Codex reveals a number of variations, which are of interest as showing the orgin of each document. Very often these corrections are only a question of style, but sometimes are worthy of attention by reason of their matter. For example, in the brief to the Bavarian Chancellor, Simon Thaddeus Eck, of Feb. 14, 1567, printed in Goubau 24-26, after '" segregare ' ' in the Codex Landau, p. 133, we read the following words : " Vere ostendis to esse fratrem loannis illius Echi qui nascenti haeresum pesti tanta pietate sese primus opposuit et catholicam veritatem tam acriter constanterque defendit." In the brief to the Emperor Maximilian IL of May 15, 1568, in Goubau 81-83, after the words " ab eo talia tentari," in the Codex Landau p. 208, we read : " Qui enim talia agunt et spretis censuris ecclesiasticis ecclesiarum bonis manus admovere non dubitant, ii nimis famae suae prodigi sunt et salutis.i Si tamen in bonis eius ecclesiae temporalibus ius .' Originally : " ii nimis officii et saliitis suae immemores sunt."
APPENDIX. 419 se aliquod habere existimat, polliciti fuimus aliquem idoneum iudicem ipsi dare, qui earn rem cognoscat et servata aequitate iudicet aut per compositionem transigat. Quod si eum iudicem a M'^' tua dari maluerit, eo quoque contenti erimus, sicut ei scripsimus. Quocirca M^«"' tuam, etc." Whereas in the brief to Eck the addition is not cancelled, here the whole of the pi rase down to " ei scripsimus " is cancelled, and instead there is placed in the margin that which is printed in GouBAU. Further, after " Quocirca Maiestatem tuam there followed : " cuius ofhcium est ut ecclesias et ecclesiarum iura tueatur, defendat et protegat " which was afterwards cancelled. That the text in Goubau is not always correct is shown by another variation : on p. 82, 1. 6 from the top, instead of " iure peti " should be read " vi peti " thus runs not only the minute in the Codex Landau, but also the volume of the register of briefs in the Papal Secret Archives, Arm. 44 t. 13- The words after " debet " in Goubau 82, 1. 5-7 from the bottom, in the Codex Landau read : " ne bona temporalia illius ecclesiae contra ius et de facto, ut dicitur, occupentur." Of general interest is an addition in the brief to the Bishop of Passau, of May 26, 1568, concerning the prohibition of communion under both kinds (Goubau 83-85 ; cf. supra P- 205, n 5). Here too it would seem that Goubau has not followed exactly the volumes of registers of briefs, since in Arm. 44, t. 13, as weU as in the Codex Landau, p. 210 seq., in this place after " habendos " (Goubau 84, i.i from the bottom), there is a long passage, which has not been cancelled, and which runs as follows : " Sed ne praedecessoris quidem nostri concessione quisquam moveri debet. Primum enim is tanta in re minus quam decuit et oportuit diligentem et maturam dehberationem habuit. Non enim ad sacrum collegium cardinahum, ut debuit et ut mos est, de tanta re rettuht, quod si fecisset et nos. qui turn de eorum numero eramus et multo maior ac sanior ut presumitur . . . [illeg- ible word] cardinalium pars nihil temere^ innovandum ess- cen.suissemus. Consuluit ille duos aut tres solum de tanto coUegio et eos potissimum quos sibi facile assensuros esse putavit. Ea tamen in re Spiritus Sancti gratia ilH manifesto affuit, quod ab iis, qui communicare sub utraque specie ' In the recristei-vohime of Briefs in the Papal Secret .Archives is the anomalous reading : " et nos et maior cardinalium pars nihil temere."
