faced in putting theory into proper practice and implementation are not simply<br />

limited to legal activities but are indeed present in all activities initiated.<br />

The Minister said that therefore, there are a number of legal frameworks and<br />

instruments that need to be reviewed and strengthened. In this regard, the Bill<br />

for Civil and Criminal Procedural Code has been submitted for deliberation in<br />

the present session of the National Assembly. The document has provisions to<br />

cover the drafting of a proper system for Jabmis and therefore, the deliberation<br />

on this subject could be continued when the Assembly considers it for<br />

ratification. With regard to a Chathrim for Jabmis, it would be better if the<br />

Judiciary drafted it. It would be in the best interest of the people if the draft<br />

were considered and ratified by the National Assembly in its next session.<br />

The representatives of the BCCI and Wangdue Phodrang submitted that the<br />

usual practice is that the Chathrim are distributed to all the Assembly members<br />

at the beginning of the National Assembly session, and after many days it is<br />

deliberated upon and ratified. Once ratified, even if there are problems with<br />

certain provisions, the implementing agencies, be it the Judiciary or the<br />

executive cannot deviate from it. They referred to the proposal made by the<br />

Speaker in the beginning of the National Assembly session, to form a<br />

legislative committee to thoroughly review all legal documents, which should<br />

be put up to the Cabinet and then to the National Assembly. It was suggested<br />

that the committee should be comprised of members from the Judiciary, people<br />

and competent representatives from the government ministries and agencies<br />

who can review legal instruments and laws well. As it would be too long to wait<br />

to form such a committee in the next session, it was suggested that the members<br />

of the committee be identified and appointed in the current session of the<br />

National Assembly.<br />

A Royal Advisory Councillor requested that the Judiciary continue the Jabmi<br />

training. He further added that in line with the 9 th Five Year Plan, which is to be<br />

geog-based, the Gup, Chimi and the Mangap should be mandated to settle minor<br />

cases and conflicts. If such cases cannot be settled and has to come to court,<br />
