able to collaborate with foreign businesses and this would greatly benefit the<br />

initiation of new industries in the country.<br />

The Minister pointed out that other countries in the modern times have reached<br />

the stage of growth and development in business and commerce through<br />

international collaboration. Likewise to develop the business and commercial<br />

sector in the country, collaborative action has to be initiated with businesses in<br />

countries with whom Bhutan shares diplomatic relations. These collaborations<br />

would not only bring new technology into the country but would also bring<br />

financial investments. It would also facilitate export of products from Bhutan.<br />

The Minister said that therefore, the Ministry of Trade and Industry has<br />

prepared three Acts which are: one, the Industrial Property Act; two, the<br />

Copyright Act; and third, the Commercial Sale of Goods Act. These Acts have<br />

been prepared with the assistance and participation of experienced expatriate<br />

experts as well as officials from different line ministries and the Judiciary. The<br />

draft Act was submitted to the Cabinet and then to the National Assembly. The<br />

Minister expressed hope that the National Assembly would also endorse the Act<br />

after reviewing and making changes that is deemed necessary. Although a copy<br />

of the draft Act was distributed to the Assembly members in the last session a<br />

few corrections have been made since then and which needs to be incorporated<br />

into the draft circulated in the last session. The Minister pointed out that the<br />

Industrial Property Act had three parts: patents and inventions; industrial<br />

designs; and marks, collective marks and trademarks.<br />

The Minister informed the Assembly that a system to provide security to<br />

industrial property in Bhutan was initiated in 1997 and the Minister submitted<br />

that with the endorsement of the Act by the Assembly the system would have<br />

legal status. The main objective of the Act is to provide security to the industrial<br />

property owner, producer and inventor and ensure that others do not copy the<br />

invention without the owner and the inventor’s permission.<br />
