June 29, 2001, and the debate on it was held on July 20, 2001.<br />

The Speaker said that there is no permanent representative of the Judiciary in<br />

the National Assembly. The Hon’ble Chief Justice has been invited as a special<br />

guest so that the honourable members can make suggestions and seek<br />

clarification on the Bill. He asked the members to be very frank in their views<br />

while suggesting amendments, additions or deletion of any provisions of the<br />

Bill.<br />

The Hon’ble Chief Justice expressed gratitude of the Judiciary for the<br />

opportunity to present the historic Bill on Civil and Criminal Procedure Code<br />

that records appreciation for the laws of the past, and also provides direction for<br />

the future.<br />

His Majesty the King has repeatedly commanded the Judiciary to guarantee and<br />

secure justice for all the people of Bhutan. In accordance with this command,<br />

there have been unprecedented judicial reforms undertaken in the last decade.<br />

Courts were improved; judicial quality enhanced through training and<br />

accountability. Rules of procedures were reviewed to expedite the judicial<br />

process and backlog of cases. In order to confer legislative authority, His<br />

Majesty the King commanded the High Court in 1991 to draft the Bill to<br />

implement judicial procedural reforms.<br />

On January 23, 1995, His Majesty the King has commissioned a high-powered<br />

Cabinet Committee to deliberate on the proposed Civil and Criminal Procedure<br />

Code. The first meeting of the Committee was convened on July 27, 1995<br />

followed by a second meeting on July 28. Another meeting was convened on<br />

July 5, 2000 where the Committee deliberated over the draft Code and amended<br />

it. The Lhengye Zhungtshog deliberated over it twice on June 4 and 21, 2001.<br />
