Boeing shall comply with 40 CFR 61.145 and 61.150 when conducting renovation ordemolition activities at the facility. [40 CFR 61.145, 41711993 and 61.150, 9/18/03]2. Boeing shall comply with <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> Regulation III, Article 4when conducting any asbestos project, renovation or demolition activities at the facility.[<strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> Regulation III, Article 4, 3/22/07]D. Spray Coating1. Applicability. This section applies to spray-coating operations at facilities subjectto Article 5 (Registration) or Article 7 (<strong>Operating</strong> <strong>Permit</strong>s) of this regulation, where acoating that protects or beautifies a surface is applied with spray-coating equipment.2. Exemptions. The following activities are exempt from the provisions of Sections9 .16( c) and (d) of this regulation. Persons claiming any of the following spray-coatingexemptions shall have the burden of demonstrating compliance with the claimed exemption.(l) Application of architectural or maintenance coatings to stationary structures (e.g.,bridges, water towers, buildings, stationary machinery, or similar structures);(2) Aerospace coating operations subject to 40 CFR Part 63, Subpart GG. Thisincludes all activities and materials listed in 40 CFR 63.741(f);(3) Use of high-volume, low-pressure (HVLP) spray guns when:(A) spray-coating operations do not involve motor vehicles or motor vehiclecomponents;(B) the gun cup capacity is 8 fluid ounces or less;(C) the spray gun is used to spray-coat less than 9 square feet per day per facility;(D) coatings are purchased in containers of 1 qUill"! or less; and(E) spray-coating is allowed by fire department, fire marshal, or othergovernment agency requirements.Boeing-Everett <strong>Permit</strong>, issued September 12, 2008; Administrative Amendment 3: October 10, 2012
