VI. PERMIT ACTIONS<strong>Permit</strong> No. 13120Expiration Date: September 12, 2013Page 287 of291application. [WAC 173-401-725, 1114/93]F. Reopening for Cause(1) Standard provisions. This permit shall be reopened and revised by the <strong>Puget</strong> <strong>Sound</strong><strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> under any of the following circumstances:a) Additional applicable requirements become applicable to Boeing with a remainingpermit term of three or more years. Such a reopening shall be completed not laterthan eighteen months after promulgation of the applicable requirement. No suchreopening is required if the effective date of the requirement is later than the date onwhich the permit is due to expire, unless the original permit or any of its terms andconditions have been extended pursuant to WAC 173-401-620(2)(j);b) Additional requirements (including excess emissions requirements) becomeapplicable to an affected source under the acid rain program. Upon approval byEPA, excess emissions offset plans shall be deemed to be incorporated into thepermit;c) The <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> or EPA determine that the permit contains amaterial mistake or that inaccurate statements were made in establishing theemissions standards or other terms or conditions of the permit; ord) The <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> or EPA determine that the permit must berevised or revoked to assure compliance with the applicable requirements.(2) Procedures. Proceedings to reopen and issue a permit shall follow the same. procedures as apply to initial permit issuance and shall affect only those parts of thepermit for which cause to reopen exists. Such reopening shall be made asexpeditiously as practicable.(3) Notice. Reopenings under this section shall not be initiated before a notice of suchintent is provided to Boeing by the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> at least thirty daysin advance of the date that the permit is to be reopened, except that the <strong>Puget</strong> <strong>Sound</strong><strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> may provide a shorter time period in the case of an emergency.[WAC 173-401-730, 1114/93]Boeing-Everett <strong>Permit</strong>, issued September J 2, 2008,' Administrative Amendment 3: October 10, 2012
