STANDARD TERMS AND CONDITIONS<strong>Permit</strong> No. 13120Expiration Date: September 12,2013Page 244 of291compliance;(4) Waives the requirement for performance tests because Boeing Everett hasdemonstrated by other means to the EPA Administrator's satisfaction that theatTected facility is in compliance with the standard; or(5) Approves shorter sampling times and smaller sample volumes whennecessitated by process variables or other factors. Nothing in this paragraphshall be construed to abrogate the EPA Administrator's authority to requiretesting under Section 114 of the Act.[40 CPR 60.8(b), 2/12/99](c)(d)(e)Performance tests shall be conducted under such conditions as the EPAAdministrator or the Control Officer shall specify to Boeing Everett based onrepresentative performance of the affected facility. Boeing Everett shall malceavailable to the EPA Administrator and Control Officer such records as may benecessary to determine the conditions of the performance tests. Operations duringperiods of startup, shutdown, and malfunction shall not constitute representativeconditions for the purpose of a performance test nor shall emissions in excess of thelevel of the applicable emission limit during periods of start-up, shutdown, andmalfunction be considered a violation of the applicable emission limit unlessotherwise specified in the applicable standard. [40 CPR 60.8(c), 2/12/99]Boeing Everett shall provide the Control Officer at least 30 days prior notice of anyperformance test to afford the Control Officer the opportunity to have an observerpresent. If after 30 days notice for an initially scheduled performance test there is adelay (due to operational problems, etc.) in conducting the scheduled performancetest, Boeing Everett shall notify the Control Officer as soon as possible of any delayin the original test date, either by providing at least 7 days prior notice of therescheduled date of the performance test, or by arranging a rescheduled date with theControl Officer by mutual agreement. [40 CPR 60.8( d), 2/12/99]Boeing Everett shall provide, or cause to be provided, performance testing facilitiesas follows:(1) Sampling ports adequate for test methods applicable to such facility.
