VI. PERMIT ACTIONS<strong>Permit</strong> No. 13120Expiration Date: September 12,2013Page 285 of291assumed to avoid an applicable requirement to which Boeing wouldotherwise be subject. Such terms and conditions include:(1) A federally enforceable emissions cap assumed to avoid classification as amodification under any provision of Title I of the FCAA; and(2) An alternative emissions limit approved pursuant to regulationspromulgated under Section 112(i)(5) of the FCAA;e) Are not modifications under any provision of Title I of the FCAA;ii) Notwithstanding (a)(i) of this subsection, and subsection (3) of this section, the<strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> may allow the use of minor permit modificationprocedures for permit modifications involving the use of economic incentives,marketable permits, emissions trading, and other similar approaches, to theextent that the use of such minor permit modification procedures is explicitlyprovided for in the Washington state implementation plan or in applicablerequirements promulgated by EPA and in etlect on April 7, 1993.b) Application. An application requesting the use of minor permit modificationprocedures shall meet the requirements of WAC 173-401-510 and shall include thefollowing:i) A description of the change, the emissions resulting from the change, and any newapplicable requirements that will apply if the change occurs;ii)Boeing's suggested draft permit;iii) Certification by a responsible official, consistent with WAC 173-401-520, of thetruth, accuracy, and completeness of the application and that the proposedmodification meets the criteria for use of minor permit modification proceduresand a request that such procedures be used; andiv) Completed forms for the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> to use to notifY EPAand affected states as required under WAC 173-401-810 and 173-401-820.c) Boeing's ability to make change. Boeing may make the change proposed in itsBoeing-Everett <strong>Permit</strong>, issued September 12, 2008; Administrative Amendment 3: October 10, 2012
