Need to halt or reduce activity not a defenseIt shall not be a defense for Boeing in an enforcement action that it would have been necessaryto halt or reduce the permitted activity in order to maintain compliance with the conditions ofthis permit. [WAC 173-401-620(2)(b), 11/4/93]U. Stratospheric ozone and climate protection1. Boeing shall comply with the following standards for recycling and emissions reductionpursuant to 40 CFR Part 82, Subpart F, except as provided for motor vehicle airconditioners (MVACs) in Subpart B:i) Persons opening appliances for maintenance, service, repair, or disposal mustcomply with the required practices pursuant to 40 CFR 82.156 (1111/05);ii) Equipment used during the maintenance, service, repair, or disposal of appliancesmust comply with the standards for recycling and recovery equipment pursuant to 40CFR 82.158 (7/24/03); andiii) Persons performing maintenance, service, repair, or disposal of appliances mustbe certified by an approved technician certification program pursuant to 40 CFR82.161 (3/12/04).2. Boeing may switch from any ozone-depleting substance to any alternative approvedpursuant to the Significant New Alternatives Program (SNAP), 40 CFR Part 82, SubpartG, without a permit revision but shall not switch to a substitute listed as unacceptablepursuant to such program.
